    1                        A bill to be entitled                      
    2         An act relating to indecent, lewd, or lascivious
    3         touching; creating s. 794.051, F.S.; defining conduct
    4         prohibited as indecent, lewd, or lascivious touching
    5         of certain minors; providing a penalty; providing
    6         applicability; amending s. 921.0022, F.S.; ranking the
    7         offense on the offense severity ranking chart of the
    8         Criminal Punishment Code; providing an effective date.
    9          
   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 794.051, Florida Statutes, is created to
   13  read:
   14         794.051 Indecent, lewd, or lascivious touching of certain
   15  minors.—
   16         (1) A person 24 years of age or older who intentionally
   17  touches in a lewd or lascivious manner the breasts, genitals,
   18  genital area, or buttocks, or the clothing covering them, of a
   19  person 16 or 17 years of age, or forces or entices a person 16
   20  or 17 years of age to so touch the perpetrator, commits a felony
   21  of the third degree, punishable as provided in s. 775.082, s.
   22  775.083, or s. 775.084.
   23         (2) This section does not apply to a person 16 or 17 years
   24  of age who has had the disability of nonage removed under
   25  chapter 743.
   26         Section 2. Paragraph (d) of subsection (3) of section
   27  921.0022, Florida Statutes, is amended to read:
