17 Section 35. Subsections (3), (4), and (5) of section
18 240.2995, Florida Statutes, are amended to read:
19 240.2995 University health services support
20 organizations.--
21 (3) The board of trustees regents of a state
22 university may prescribe, by rule, conditions with which a
23 university health services support organization must comply in
24 order to be certified and to use property, facilities, or
25 personal services at any state university. The rules must
26 provide for budget, audit review, and oversight by the board
27 of trustees regents of the state university. Such rules shall
28 provide that the university health services support
29 organization may provide salary supplements and other
30 compensation or benefits for university faculty and staff
31 employees only as set forth in the organization's budget,

1 which shall be subject to approval by the university
2 president.
3 (4) The chair of the board of trustees regents of a
4 state university may appoint a representative to the board of
5 directors and the executive committee of any university health
6 services support organization established under this section.
7 The president of the university for which the university
8 health services support organization is established, or the
9 president's designee, shall also serve on the board of
10 directors and the executive committee of any university health
11 services support organization established to benefit that
12 university.
13 (5) Each university health services support
14 organization shall make provisions for an annual postaudit of
15 its financial accounts to be conducted by an independent
16 certified public accountant in accordance with rules of the
17 board of trustees regents of a state university. The annual
18 audit report shall include a management letter and shall be
19 submitted to the Auditor General and the board of regents for
20 review. The board of trustees regents of a state university
21 and the Auditor General may shall have the authority to
22 require and receive from the organization or from its
23 independent auditor any detail or supplemental data relative
24 to the operation of the organization. The auditor's report,
25 management letter, and any supplemental data requested by the
26 board of trustees regents of a state university and the
27 Auditor General shall be considered public records, pursuant
28 to s. 119.07.
