  1                      A bill to be entitled

  2         An act relating to postsecondary education;

  3         amending s. 240.1201, F.S.; providing that

  4         active members of the Florida National Guard

  5         are residents of this state for tuition

  6         purposes; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Paragraph (a) of subsection (10) of section

11  240.1201, Florida Statutes, is amended to read:

12         240.1201  Determination of resident status for tuition

13  purposes.--Students shall be classified as residents or

14  nonresidents for the purpose of assessing tuition fees in

15  public community colleges and universities.

16         (10)  The following persons shall be classified as

17  residents for tuition purposes:

18         (a)  Active duty members of the Armed Services of the

19  United States residing or stationed in this state, their

20  spouses, and dependent children, and active members of the

21  Florida National Guard who qualify under s. 250.10(7) and (8)

22  for the tuition assistance program.

23         Section 2.  This act shall take effect July 1, 2002.

26                          SENATE SUMMARY

27    Provides that active members of the Florida National
      Guard are residents of this state for purposes of
28    assessing tuition fees in public community colleges and
      universities.
