12  amendment (803811):

14         Senate Amendment (with title amendment) 
15         On page 5, line 15, through
16            page 8, line 4, delete those lines
17  
18  and insert:  
19         Section 4.  Paragraph (c) is added to subsection (7) of
20  section 627.736, Florida Statutes, to read:
21         627.736  Required personal injury protection benefits;
22  exclusions; priority; claims.--
23         (7)  MENTAL AND PHYSICAL EXAMINATION OF INJURED PERSON;
24  REPORTS.--
25         (c)  Any insurer requesting an examination under this
26  subsection shall ensure that the discovery provided for in
27  Allstate v. Boecher, 733 So. 2d 993 (Fla. 1999) is available.
28  If the required discovery is not provided, then the expert's
29  opinions may not form the basis for a claim denial.
