14 On page 167, between lines 29 and 30,

16 insert:
17 Section 33. Subsections (4) and (6) of section
18 627.091, Florida Statutes, are amended to read:
19 627.091 Rate filings; workers' compensation and
20 employer's liability insurances.--
21 (4) An insurer may not satisfy its obligation to make
22 such filings by becoming a member of, or a subscriber to, a
23 licensed rating organization or which makes such filings and
24 by authorizing the organization to make, and the department to
25 accept, such filings in its behalf, and; but nothing contained
26 in this chapter shall be construed as requiring any insurer to
27 become a member or a subscriber to any rating organization.
28 (6) Notwithstanding subsection (4), whenever the
29 committee of a recognized rating organization with
30 responsibility for workers' compensation and employer's
31 liability insurance rates in this state meets to discuss the

1 necessity for, or a request for, Florida workers' compensation
2 or employer's liability insurance rate increases or decreases,
3 the determination of Florida rates, the rates to be requested,
4 and any other matters pertaining specifically and directly to
5 such Florida rates, the such meetings shall be held in this
6 state and shall be subject to s. 286.011. The committee of
7 such a rating organization shall provide at least 3 weeks'
8 prior notice of the such meetings to the department and shall
9 provide at least 14 days' prior notice of the such meetings to
10 the public by publication in the Florida Administrative
11 Weekly.
