11 Senator Cowin moved the following amendment:

14 On page 13, lines 15 and 16, delete those lines
15
16 and insert:
17 Section 10. Subsections (2) and (3) of section
18 400.991,Florida Statutes, are amended to read:
19 400.991 License requirements; background screenings;
20 prohibitions.--
21 (2) The initial clinic license application shall be
22 filed with the agency by all clinics, as defined in s.
23 400.9905, on or before July 1 March 1, 2004. A clinic license
24 must be renewed biennially.
25 (3) Applicants that submit an application on or before
26 July 1 March 1, 2004, which meets all requirements for initial
27 licensure as specified in this section shall receive a
28 temporary license until the completion of an initial
29 inspection verifying that the applicant meets all requirements
30 in rules authorized by s. 400.9925. However, a clinic engaged
31 in magnetic resonance imaging services may not receive a

1 temporary license unless it presents evidence satisfactory to
2 the agency that such clinic is making a good faith effort and
3 substantial progress in seeking accreditation required under
4 s. 400.9935.
5 Section 11. This act shall take effect upon becoming a
6 law and section 10 shall apply retroactively to March 1, 2004.

13 and insert:
14 amending s. 400.991, F.S.; changing the date by
15 which an initial application for a health care
16 clinic license must be filed with the Agency
17 for Health Care Administration; making
18 conforming changes to the requirement that
19 qualified applicants receive a temporary
20 license; providing for retroactive application;
