  1                      A bill to be entitled

  2         An act relating to homeowners' associations;

  3         amending s. 720.306, F.S.; prohibiting members

  4         of such associations who are subject to

  5         mandatory assessments from being denied the

  6         right to vote on association matters; providing

  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (9) is added to section 720.306,

12  Florida Statutes, to read:

13         720.306  Meetings of members; voting and election

14  procedures; amendments.--

15         (9)  VOTING RIGHTS.--Notwithstanding any contrary

16  provision in a declaration or document creating an

17  association, a person subject to mandatory assessment

18  provisions for association expenses may not be denied the

19  right to vote, except as provided in s. 720.305(3).

20         Section 2.  This act shall take effect July 1, 2004.
