11 The Committee on Judiciary (Geller) recommended the following
12 amendment:

15 On page 9, lines 1-7, delete those lines
16
17 and insert:
18 (b) Continue to be in compliance with chapter 550,
19 where applicable, and maintain the pari-mutuel permit and
20 license in good standing pursuant to the provisions of chapter
21 550. Notwithstanding any contrary provision of law and in
22 order to expedite the operation of slot machines at eligible
23 facilities, any eligible facility shall be entitled within 60
24 days of the effective date of this act to amend its 2005-2006
25 license issued by the Division of Pari-Mutuel Wagering and
26 shall be granted the requested changes in its authorized
27 performances pursuant to such amendment. The Division of
28 Pari-mutuel Wagering shall issue a new license to the eligible
29 facility to effectuate an amendment.
30 (c) Conduct no fewer than the greater number of live
31 races or games that were conducted at that pari-mutuel

1 facility in calendar year 2002 or calendar year 2003.
2 However, a permitholder's failure to conduct such number of
3 live races or games in any year shall be reduced by the number
4 of such races or games which cannot be conducted due to the
5 direct result of fire, war, or other disaster or event beyond
6 the ability of the permitholder to control.
