12  recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         Delete everything after the enacting clause
16  
17  and insert:  
18         Section 1.  Section 4 of ch. 2003-420, Laws of Florida,
19  is amended to read:
20         Section 4.  Notwithstanding any other provision of law,
21  the county in which the projects that are part of or ancillary
22  to the state-of-the-art biomedical research institution and
23  campus to be established in this state by the grantee under
24  section 288.955, Florida Statutes, are to be located shall
25  have the exclusive right, which right may be assigned in whole
26  or in part by the governing body of the county in its sole
27  discretion, to provide water and wastewater services to such
28  projects to the extent deemed necessary by the governing body
29  of the county. The county may plan, acquire, construct,
30  reconstruct, enlarge or extend, operate, and maintain water
31  and wastewater systems and facilities within or without the

 1  boundaries of such projects for the provision of water and
 2  wastewater services. Provided, the local government or utility
 3  service provider shall not be authorized to use the provisions
 4  of chapters 73 or 74, Florida Statutes, or any other
 5  applicable law, to acquire by eminent domain the property of
 6  any other governmental entity in order to provide water and
 7  waste-water service to the biomedical research facility
 8  authorized pursuant to s. 288.955, Florida Statutes.
 9         Section 5.  This act shall take effect upon becoming a
10  law.

18                      A bill to be entitled
19         An act relating to the Scripps Funding
20         Corporation; amending s. 4 of ch. 2003-420,
21         L.O.F.; prohibiting the use of eminent domain
22         against other governmental entities under
23         certain circumstances; providing an effective
24         date.
