| 4 | Remove everything after the resolving clause and insert: |
| 5 | That the amendment to Section 3 of Article XI and the |
| 6 | creation of Section 26 of Article XII of the State Constitution |
| 7 | is agreed to and shall be submitted to the electors of this |
| 8 | state for approval or rejection at the next general election or |
| 9 | at an earlier special election specifically authorized by law |
| 10 | for that purpose: |
| 11 | ARTICLE XI |
| 12 | AMENDMENTS |
| 13 | SECTION 3. Initiative.-- |
| 14 | (a) The power to propose the revision or amendment of any |
| 15 | portion or portions of this constitution by initiative is |
| 16 | reserved to the people, provided that, any such revision or |
| 17 | amendment, except for those limiting the power of government to |
| 18 | raise revenue, shall embrace but one subject and matter directly |
| 19 | connected therewith. Any revision or amendment proposed by |
| 20 | initiative shall: |
| 21 | (1) Amend or repeal an existing section of this |
| 22 | constitution on the same subject and matter; |
| 23 | (2) Address a basic or fundamental right of a citizen of |
| 24 | this state; or |
| 25 | (3) Change the basic structure of state government as |
| 26 | established in Article II, Article III, Article IV, or Article V |
| 27 | of this constitution, except that no revision or amendment shall |
| 28 | deprive the branches of government of any existing powers |
| 29 | granted in these articles. |
| 30 | (b) The initiative power It may be invoked by filing with |
| 31 | the custodian of state records a petition containing a copy of |
| 32 | the proposed revision or amendment, signed by a number of |
| 33 | electors in each of one half of the congressional districts of |
| 34 | the state, and of the state as a whole, equal to eight percent |
| 35 | of the votes cast in each of such districts respectively and in |
| 36 | the state as a whole in the last preceding election in which |
| 37 | presidential electors were chosen. |

| 39 | SCHEDULE |
| 40 | SECTION 26. Permissible subject matter of constitutional |
| 41 | revisions or amendments proposed by initiative.--The amendment |
| 42 | to Section 3 of Article XI, to provide that a constitutional |
| 43 | revision or amendment proposed by initiative must amend or |
| 44 | repeal an existing section of this constitution on the same |
| 45 | subject and matter; must address a basic or fundamental right of |
| 46 | a citizen of this state; or must change the basic structure of |
| 47 | state government as established in Article II, Article III, |
| 48 | Article IV, or Article V of this constitution, except that no |
| 49 | revision or amendment may deprive the branches of government of |
| 50 | any existing powers granted in these articles, shall take effect |
| 51 | upon approval by the electors. |
| 52 | BE IT FURTHER RESOLVED that the title and substance of the |
| 53 | amendment proposed herein shall appear on the ballot as follows: |
| 54 | PERMISSIBLE SUBJECT MATTER OF CONSTITUTIONAL REVISIONS |
| 55 | OR AMENDMENTS PROPOSED BY INITIATIVE |
| 56 | Proposes an amendment to Section 3 of Article XI of the |
| 57 | State Constitution to provide that a constitutional revision or |
| 58 | amendment proposed by initiative must amend or repeal an |
| 59 | existing section of the State Constitution on the same subject |
| 60 | and matter; must address a basic or fundamental right of a |
| 61 | citizen of this state; or must change the basic structure of |
| 62 | state government as established in Article II, Article III, |
| 63 | Article IV, or Article V of the State Constitution, except that |
| 64 | no revision or amendment may deprive the branches of government |
| 65 | of any existing powers granted in these articles; and proposes |
| 66 | the creation of Section 26 of Article XII to provide that the |
| 67 | amendment to Section 3 of Article XI shall take effect upon |
| 68 | approval by the electors. |
