  1                      A bill to be entitled

  2         An act relating to the East County Water

  3         Control District, Lee and Hendry Counties;

  4         amending chapter 2000-423, Laws of Florida;

  5         authorizing the district to sell, lease, or

  6         otherwise encumber surplus real property owned

  7         by the district; providing an exception;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (12) is added to section 4 of

13  section 3 of chapter 2000-423, Laws of Florida, to read:

14         Section 4.  Board of Supervisors; elections; candidate

15  qualifications; powers and duties.--The provisions of chapter

16  298, Florida Statutes, to the contrary notwithstanding, the

17  following provisions, to the extent of any conflict, shall

18  control the East County Water Control District:

19         (12)  The District shall have the authority to sell,

20  lease, or otherwise encumber surplus real property owned by

21  the District for the benefit of the District, except for

22  environmentally sensitive property as designated by the

23  Florida Department of Environmental Protection.

24         Section 2.  This act shall take effect upon becoming a

25  law.
