  2         An act relating to the Florida Space Research

  3         Institute; amending s. 331.368, F.S.; revising

  4         the purpose of the institute; providing for the

  5         institute to serve as a multi-university center

  6         for research and technology development;

  7         requiring the institute to submit a plan to the

  8         Board of Governors for its operation;

  9         authorizing the institute to leverage certain

10         funding for certain purposes; revising

11         membership of the Board of the Florida Space

12         Research Institute; providing for the board to

13         invite participation of Embry Riddle

14         Aeronautical University; deleting requirement

15         for the board to select a lead university;

16         deleting requirement to comanage with the

17         National Aeronautics and Space Administration

18         the Space Experiment Research and Processing

19         Laboratory; providing for such comanagement of

20         the Space Life Sciences Lab at the John F.

21         Kennedy Space Center; revising requirement that

22         the board develop certain initiatives to

23         include space exploration; revising requirement

24         that the board coordinate and conduct research

25         in certain fields to include space exploration;

26         providing appropriations for certain purposes;

27         providing effective dates.

 1         Section 1.  Subsections (1), (2), and (7) of section

 2  331.368, Florida Statutes, are amended to read:

 3         331.368  Florida Space Research Institute.--

 4         (1)  There is created the Florida Space Research

 5  Institute, the purpose of which is to serve as an

 6  industry-driven center for research, leveraging the state's

 7  resources in a collaborative effort to support Florida's space

 8  industry and its expansion, diversification, and transition to

 9  commercialization.

10         (a)  The institute shall submit a plan to the Board of

11  Governors before June 30, 2005, for its operation as a

12  multi-university center for space-focused research and

13  technology development, consistent with the emerging needs of

14  government and commercial space programs.

15         (b)  The institute may leverage annual funding from the

16  National Aeronautics and Space Administration for grants to

17  Florida academic institutions and industry for the purpose of

18  growing and diversifying the state's role in space research

19  and sponsoring education and training projects that will

20  support future aerospace workforce needs in the state.

21         (2)  The institute shall operate as a public/private

22  partnership under the direction of a board composed of:

23         (a)  A representative of the Florida Space Authority.

24         (b)  A representative of Enterprise Florida, Inc.

25         (c)  A representative of the Florida Aviation Aerospace

26  Alliance.

27         (d)  A representative of the Florida Space Business

28  Roundtable.

29         (d)(e)  Additional private-sector representatives from

30  the space industry selected collaboratively by the core

31  members specified in paragraphs (a)-(c)(d). The additional

 1  space industry representatives under this paragraph must

 2  comprise the majority of members of the board and must be from

 3  geographic regions throughout the state. Each private-sector

 4  representative shall be appointed to a term of 3 years.

 5         (e)(f)  At least two representatives from the

 6  educational community who are selected collaboratively by the

 7  core members specified in paragraphs (a)-(c)(d) and who are

 8  engaged in research or instruction related to the space

 9  industry. One representative must be from a community college,

10  and one representative must be from a public or private

11  university. Each educational representative shall be appointed

12  to a term of 2 years.

13         (f)(g)  Additional ex officio, nonvoting

14  representatives selected collaboratively by the core members.

15         (7)  The board of the Florida Space Research Institute

16  shall:

17         (a)  Set the strategic direction for the space-related

18  research priorities of the state and its space-related

19  businesses, the scope of research projects for the institute,

20  and the timeframes for completion.

21         (b)  Invite the participation of public and private

22  academic institutions, including, but not limited to, the

23  University of Central Florida, the University of Florida, the

24  University of South Florida, Florida State University, Florida

25  Institute of Technology, Embry Riddle Aeronautical University,

26  and the University of Miami.

27         (c)  Select a lead university to:

28         1.  Serve as coordinator of research for the institute;

29         2.  Support the institute's development of a statewide

30  space research agenda and programs; and

 1         3.  Develop, and update as necessary, a report

 2  recommending ways that the state's public and private

 3  universities can work in partnership to support the state's

 4  space-industry requirements.

 5         (c)(d)  Establish a partnership with the state

 6  Workforce Development Board, or its successor entity, under

 7  which the institute coordinates the workforce-training

 8  requirements identified by the space industry and supports

 9  development of workforce-training initiatives to meet such

10  requirements, using training providers approved by the board

11  or its successor entity.

12         (d)(e)  Comanage, with the National Aeronautics and

13  Space Administration and subject to the terms of an agreement

14  with NASA, operation of the a Space Life Sciences Lab at

15  Experiment Research and Processing Laboratory, if such a

16  facility is constructed on land of the John F. Kennedy Space

17  Center. The institute shall carry out such responsibility

18  through a consortium of public and private universities in the

19  state led by the University of Florida.

20         (e)(f)  Develop initiatives to foster the participation

21  of the state's space industry in the International Space

22  Station and space exploration and to help the state maintain

23  and enhance its competitive position in the commercial

24  space-transportation industry.

25         (f)(g)  Pursue partnerships with the National

26  Aeronautics and Space Administration to coordinate and conduct

27  research in fields including, but not limited to, space

28  exploration, environmental monitoring; agriculture; aquatics;

29  resource reutilization technologies for long-duration space

30  missions; and spaceport technologies which support current or

31  next-generation launch vehicles and range systems.

 1         (g)(h)  Pursue partnerships with the National

 2  Aeronautics and Space Administration for the conduct of

 3  space-related research using computer technology to connect

 4  experts in a given field of science who are in disparate

 5  locations and to perform research experiments in a real-time,

 6  virtual environment.

 7         (h)(i)  Appoint or dismiss, as deemed necessary by the

 8  board, a person to act as executive director of the institute,

 9  who shall have such other functions, duties, powers, and

10  salary as the board prescribes.

11         Section 2.  Effective July 1, 2005, the sum of $10

12  million is appropriated from the General Revenue Fund to the

13  Department of Education for fiscal year 2005-2006 for the

14  purpose of establishing the Florida Space Research Institute

15  as a multi-university center for space research and technology

16  development.

17         Section 3.  Effective July 1, 2005, the sum of $1

18  million is appropriated from the General Revenue Fund to

19  Florida Atlantic University for the purpose of investing in

20  the Florida Space Research Institute's matching grant program

21  with the National Aeronautics and Space Administration.

22         Section 4.  Except as otherwise provided in this act,

23  this act shall take effect upon becoming a law.
