  1                      A bill to be entitled

  2         An act relating to robbery on religious real

  3         property; creating s. 812.134, F.S.; defining

  4         the terms "robbery while on religious property"

  5         and "religious real property"; providing that a

  6         person who attempts to commit robbery or who

  7         commits robbery while on religious real

  8         property commits a felony of the first degree;

  9         providing criminal penalties; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Section 812.134, Florida Statutes, is

15  created to read:

16         812.134  Robbery while on religious real property.--

17         (1)  As used in this section, the term:

18         (a)  "Robbery while on religious property" means any

19  attempted robbery or robbery that occurs when a person enters

20  religious real property with the intent to commit a robbery

21  and attempts to commit a robbery or does commit a robbery of

22  the occupants therein.

23         (b)  "Religious real property" means any church,

24  synagogue, mosque, or other house of worship at which a church

25  or religious organization regularly conducts religious

26  services.

27         (2)  A person who commits robbery while on religious

28  real property commits a felony of the first degree, punishable

29  as provided in s. 775.082, s. 775.083, or s. 775.084.

30         Section 2.  This act shall take effect October 1, 2005.
