2 An act relating to tuition rates at state
3 colleges and universities; creating s.
4 1009.286, F.S.; requiring students to pay the
5 out-of-state tuition rate for credit hours in
6 excess of a specified number for
7 community-college credits and for overall
8 credits applied to a baccalaureate degree;
9 creating s. 1009.287, F.S.; providing for
10 tuition rebates for students who take minimal
11 excess hours in earning a baccalaureate degree;
12 providing a maximum allowable amount for such a
13 rebate; providing conditions to such a rebate;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Section 1009.286, Florida Statutes, is
19 created to read:
20 1009.286 Additional student payment required for hours
21 exceeding graduation requirements.--
22 (1) It is the intent of the Legislature to discourage
23 undergraduate students in postsecondary education from
24 exceeding the number of credit hours required to complete the
25 students' respective degree programs. Accordingly, a student
26 must pay the out-of-state tuition rate for any credit hours
27 that the student takes in excess of 115 percent of the number
28 of credit hours required to complete the degree program in
29 which he or she is enrolled.
30 (2) A student who is enrolled in a community college
31 must pay the out-of-state tuition rate for credit hours that

1 the student takes in excess of 115 percent of the 60 credit
2 hours required to earn an associate in arts degree, except
3 that a community college student who has earned the associate
4 in arts degree need not pay the full cost for a maximum of 24
5 hours taken while enrolled at a community college which apply
6 to his or her baccalaureate degree under s. 1009.25.
7 (3) An undergraduate student who is enrolled in a
8 university that is part of the state university system must
9 pay the out-of-state tuition rate for credit hours that the
10 student takes in excess of 115 percent of the 120 hours
11 required to earn a baccalaureate degree, regardless of whether
12 those hours were taken while enrolled at a community college
13 or an institution that grants baccalaureate degrees.
14 Section 2. Section 1009.287, Florida Statutes, is
15 created to read:
16 1009.287 Tuition rebates for having minimal excess
17 hours.--A student who has received a baccalaureate degree from
18 a state university in this state is entitled to receive a
19 rebate of 50 percent of any tuition fees that he or she has
20 paid for all undergraduate credit hours in this state if he or
21 she graduates without exceeding by more than 3 credit hours
22 the required number of hours for his or her enrolled degree
23 program.
24 (2) The maximum total amount of a rebate awarded under
25 subsection (1) is $1,000, and a rebate may not be given for
26 any portion of a tuition fee that has been paid by a person or
27 entity other than the student or his or her parent or
28 guardian.
29 (3) A student must apply for such a rebate to the
30 State Board of Education on a form devised by the state board

1 and may not apply for the rebate until after he or she has
2 been awarded the baccalaureate degree.
3 (4) Entitlement to the rebate provided for in this
4 section is contingent upon legislative appropriation of
5 funding for the year in which a student graduates and
6 qualifies for the rebate.
7 Section 3. This act shall take effect July 1, 2005.
