  1                      A bill to be entitled

  2         An act relating to child safety; requiring

  3         school boards to promulgate policies regarding

  4         release of children; providing a definition;

  5         requiring copies of the policies to be provided

  6         to the Department of Education; requiring

  7         nonpublic schools, private schools, and certain

  8         child care facilities to promulgate policies

  9         regarding release of children; requiring making

10         such policies available on the premises of the

11         schools or child care facilities; providing a

12         definition; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  No later than July 1, 2006, the school

17  board of each public school district must promulgate policies

18  that will ensure that the students in that school district are

19  not released from the schools to persons who are not

20  authorized to retrieve them. These policies must include a

21  requirement that a person attempting to retrieve the student

22  present a picture identification to the school principal or

23  his or her designee before the student is released to the

24  person. As used in this section, the term "picture

25  identification" means a valid state driver's license, a valid

26  state identification card, or a valid United States military

27  identification card. Copies of the policies must be provided

28  to the Department of Education.

29         Section 2.  No later than July 1, 2006, each nonpublic

30  school exempt from licensure under section 402.3025, Florida

31  Statutes, child care facility licensed under section 402.305,

 1  Florida Statutes, family day care home licensed or registered

 2  under section 402.3131, Florida Statutes, private school as

 3  defined in section 1002.01, Florida Statutes, and faith-based

 4  child care provider exempt from licensure under section

 5  402.316, Florida Statutes must promulgate policies that will

 6  ensure that the children in that nonpublic school, child care

 7  facility, day care home, private school, or faith-based child

 8  care provider are not released to persons who are not

 9  authorized to retrieve them. These policies must include a

10  requirement that the person attempting to retrieve the child

11  must present a picture identification to the appropriate

12  school or child care official or his or her designee before

13  the child is released to the person. As used in this section,

14  the term "picture identification" means a valid state drivers

15  license, a valid state identification card, or a valid United

16  States military identification card. Copies of these policies

17  must be maintained on the premises of each entity covered by

18  this section and be readily available for inspection.

19         Section 3.  This act shall take effect July 1, 2005.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         senate bill 246

 3                                 

 4  Places the responsibility for developing policies to ensure
    that children are not released from public schools to persons
 5  not authorized to receive them on local school boards.

 6  Requires that the policies be developed by school boards no
    later than July 1, 2006, and that copies of the policies be
 7  provided to the Department of Education.

 8  Requires non-public schools and child care providers to
    develop policies to ensure that children are not released to
 9  persons not authorized to receive them and to make these
    policies readily available for public inspection.

    Retains the requirement that theses policies include
11  presentation of picture identification of individuals seeking
    to retrieve children. Retains definition of picture
12  identification. /
