12 (Lawson) recommended the following amendment:

14 Senate Amendment (with title amendment)
15 On page 4, between lines 21 and 22,
16
17 insert:
18 Section 4. Restoration activities for the Lake
19 Okeechobee Restoration Program managed by the Department of
20 Environmental Protection, the Department of Agriculture and
21 Consumer Services, the Fish and Wildlife Conservation
22 Commission, or the South Florida Water Management District are
23 exempt from the competitive procurement requirements
24 established in section 287.057, Florida Statutes, but shall
25 comply with the provisions of section 337.11, Florida
26 Statutes, to the extent that the entities award proposed
27 construction, operations, and maintenance work to the lowest
28 responsible bidder or to the lowest evaluated responsible
29 bidder in a time-plus-money contract. The contract may
30 provide for an incentive payment to the contractor for early
31 completion of the project or critical phases of the work and

1 for damages to be assessed against the contractor for the
2 completion of the project or critical phases of the working
3 excess of the time specified. Regardless of the option
4 elected, the protect procedures in section 120.57(3), Florida
5 Statutes, apply to all such contracts.
