14 On page 46, line 19, through page 47, line 15, delete
15 those lines

17 and insert:
18 (6) The Legislative Budget Commission may approve
19 increases to the maximum annual budgets approved for
20 individual clerks of the court pursuant to s. 28.36 for court
21 related duties, if either of the following conditions exist:
22 (a) The additional funding is necessary to pay the
23 cost of performing new or additional functions required by
24 changes in law or court rule. Before the Legislative Budget
25 Commission may approve an increase in the maximum annual
26 budget of any clerk under this paragraph, the Clerk of the
27 Court Operations Corporation must provide the Legislative
28 Budget Commission with a statement of the impact of the
29 proposed budget changes on state revenues, and evidence that
30 the respective clerk of the court is meeting or exceeding the
31 established performance standards for measures on the fiscal

1 management, operational efficiency, and effective collection
2 of fines, fees, service charges, and court costs.
3 (b) The additional funding is necessary to pay the
4 cost of supporting increases in the number of judges or
5 magistrates authorized by the Legislature. Before the
6 Legislative Budget Commission may approve an increase in the
7 maximum annual budget of any clerk under this paragraph, the
8 Clerk of the Court Operations Corporation must provide the
9 Legislative Budget Commission with a statement of the impact
10 of the proposed budget changes on state revenues; evidence
11 that the respective clerk of the court is meeting or exceeding
12 the established performance standards for measures on the
13 fiscal management, operational efficiency, and effective
14 collection of fines, fees, service charges, and court costs;
15 and a proposed staffing model, including the cost and number
16 of staff necessary to support each new judge or magistrate.

18 The total amount of increases approved by the Legislative
19 Budget Commission for each county fiscal year shall not exceed
20 an amount equal to 2 percent of the maximum annual budgets
21 approved pursuant to s. 28.36 for all clerks, in the
22 aggregate, for that same county fiscal year.
