A bill to be entitled
2An act relating to public school student progression;
3amending s. 1008.25, F.S.; requiring the comprehensive
4program for student progression to include assessment of
5performance in social studies; clarifying participation in
6the statewide assessment program; amending ss. 1003.51 and
71003.52, F.S.; conforming provisions relating to subject
8area grade level proficiency of students in Department of
9Juvenile Justice education programs; specifying that the
10act does not require a change in subject areas measured by
11the statewide assessment program; providing an effective
12date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Subsection (1), paragraph (b) of subsection
17(2), paragraph (a) of subsection (4), and paragraph (a) of
18subsection (8) of section 1008.25, Florida Statutes, are amended
19to read:
20     1008.25  Public school student progression; remedial
21instruction; reporting requirements.--
22     (1)  INTENT.--It is the intent of the Legislature that each
23student's progression from one grade to another be determined,
24in part, upon proficiency in reading, writing, science, social
25studies, and mathematics; that district school board policies
26facilitate such proficiency; and that each student and his or
27her parent be informed of that student's academic progress.
28     (2)  COMPREHENSIVE PROGRAM.--Each district school board
29shall establish a comprehensive program for student progression
30which must include:
31     (b)  Specific levels of performance in reading, writing,
32science, social studies, and mathematics for each grade level,
33including the levels of performance on statewide assessments in
34those subject areas for which assessment tests are available and
35as defined by the commissioner, below which a student must
36receive remediation, or be retained within an intensive program
37that is different from the previous year's program and that
38takes into account the student's learning style.
39     (4)  ASSESSMENT AND REMEDIATION.--
40     (a)  Each student must participate in the statewide
41assessment tests required by s. 1008.22 in those subject areas
42for which assessment tests are available. Each student who does
43not meet specific levels of performance as determined by the
44district school board in reading, writing, science, social
45studies, and mathematics for each grade level, or who does not
46meet specific levels of performance as determined by the
47commissioner on statewide assessments at selected grade levels,
48must be provided with additional diagnostic assessments to
49determine the nature of the student's difficulty and areas of
50academic need.
51     (8)  ANNUAL REPORT.--
52     (a)  In addition to the requirements in paragraph (5)(b),
53each district school board must annually report to the parent of
54each student the progress of the student toward achieving state
55and district expectations for proficiency in reading, writing,
56science, social studies, and mathematics. The district school
57board must report to the parent the student's results on each
58statewide assessment test. The evaluation of each student's
59progress must be based upon the student's classroom work,
60observations, tests, district and state assessments, and other
61relevant information. Progress reporting must be provided to the
62parent in writing in a format adopted by the district school
63board.
64     Section 2.  Paragraph (c) of subsection (3) of section
651003.51, Florida Statutes, is amended to read:
66     1003.51  Other public educational services.--
67     (3)  The Department of Education in partnership with the
68Department of Juvenile Justice, the district school boards, and
69providers shall:
70     (c)  Maintain standardized required content of education
71records to be included as part of a youth's commitment record.
72These requirements shall reflect the policy and standards
73adopted pursuant to subsection (2) and shall include, but not be
74limited to, the following:
75     1.  A copy of the student's individual educational plan.
76     2.  Assessment data, including grade level proficiency in
77reading, writing, science, social studies, and mathematics, and
78performance on tests taken according to s. 1008.22.
79     3.  A copy of the student's permanent cumulative record.
80     4.  A copy of the student's academic transcript.
81     5.  A portfolio reflecting the youth's academic
82accomplishments while in the Department of Juvenile Justice
83program.
84     Section 3.  Subsection (7) of section 1003.52, Florida
85Statutes, is amended to read:
86     1003.52  Educational services in Department of Juvenile
87Justice programs.--
88     (7)  An academic improvement plan shall be developed for
89students who score below the level specified in district school
90board policy in reading, writing, science, social studies, and
91mathematics or below the level specified by the Commissioner of
92Education on statewide assessments as required by s. 1008.25.
93These plans shall address academic, literacy, and life skills
94and shall include provisions for intensive remedial instruction
95in the areas of weakness.
96     Section 4.  Nothing in this act shall require a change in
97the subject areas measured by the statewide assessment program
98pursuant to s. 1008.22, Florida Statutes.
99     Section 5.  This act shall take effect July 1, 2005.
