  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         106.426, F.S.; creating the Clean Money Trust

  4         Fund, to be administered by the Department of

  5         State; providing for source of funds and

  6         purposes; providing for review and termination

  7         or re-creation of the trust fund; providing a

  8         contingent effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Section 106.426, Florida Statutes, is

13  created to read:

14         106.426  Clean Money Trust Fund.--

15         (1)  There is created the Clean Money Trust Fund, to be

16  administered by the Department of State. Funds shall be

17  credited to the trust fund as provided in s. 106.423, to be

18  used for the purposes of the Florida Clean Elections Act as

19  set forth in ss. 106.401-106.426.

20         (2)  In accordance with s. 19(f)(2), Art. III of the

21  State Constitution, the Clean Money Trust Fund shall be

22  terminated on July 1, 2009, unless terminated sooner. Before

23  its scheduled termination, the trust fund shall be reviewed as

24  provided in s. 215.3206(1) and (2).

25         Section 2.  This act shall take effect July 1, 2005, if

26  Senate Bill ____ or similar legislation creating the Florida

27  Clean Elections Act is adopted in the same legislative session

28  or an extension thereof and becomes law.
