14 On page 1, line 9, through
15 page 3, line 15, delete those lines

17 and insert:
18 Section 1. Paragraphs (b) and (c) of subsection (1)
19 and subsection (9) of section 320.0848, Florida Statutes, are
20 amended to read:
21 320.0848 Persons who have disabilities; issuance of
22 disabled parking permits; temporary permits; permits for
23 certain providers of transportation services to persons who
24 have disabilities.--
25 (1)
26 (b)1. The person must be currently certified as being
27 legally blind or as having any of the following disabilities
28 that render him or her unable to walk 200 feet without
29 stopping to rest:
30 a. Inability to walk without the use of or assistance
31 from a brace, cane, crutch, prosthetic device, or other

1 assistive device, or without the assistance of another person.
2 If the assistive device significantly restores the person's
3 ability to walk to the extent that the person can walk without
4 severe limitation, the person is not eligible for the
5 exemption parking permit.
6 b. The need to permanently use a wheelchair.
7 c. Restriction by lung disease to the extent that the
8 person's forced (respiratory) expiratory volume for 1 second,
9 when measured by spirometry, is less than 1 liter, or the
10 person's arterial oxygen is less than 60 mm/hg on room air at
11 rest.
12 d. Use of portable oxygen.
13 e. Restriction by cardiac condition to the extent that
14 the person's functional limitations are classified in severity
15 as Class III or Class IV according to standards set by the
16 American Heart Association.
17 f. Severe limitation in the person's ability to walk
18 due to an arthritic, neurological, or orthopedic condition.
19 2. The certification of disability which is required
20 under subparagraph 1. must be provided by a physician licensed
21 under chapter 458, chapter 459, or chapter 460, by a podiatric
22 physician licensed under chapter 461, by an optometrist
23 licensed under chapter 463, by an advanced registered nurse
24 practitioner licensed under chapter 464 in a facility operated
25 by the United States Department of Veterans Affairs under the
26 protocol of a licensed physician as stated in this
27 subparagraph, by a physician assistant licensed under chapter
28 458 or chapter 459 in a facility operated by the United States
29 Department of Veterans Affairs, by the Adjudication Office of
30 the United States Department of Veterans Affairs or its
31 predecessor, or by a similarly licensed physician from another

1 state if the application is accompanied by documentation of
2 the physician's licensure in the other state and a form signed
3 by the out-of-state physician verifying his or her knowledge
4 of this state's eligibility guidelines.
5 (c) The certificate of disability must include, but
6 need not be limited to:
7 1. The disability of the applicant; the certifying
8 practitioner's physician's name and address; the
9 practitioner's physician's certification number; the
10 eligibility criteria for the permit; the penalty for
11 falsification by either the certifying practitioner physician
12 or the applicant; the duration of the condition that entitles
13 the person to the permit; and justification for the additional
14 placard pursuant to subsection (2).
15 2. The statement, in bold letters: "A disabled parking
16 permit may be issued only for a medical necessity that
17 severely affects mobility."
18 3. The signatures of:
19 a. The applicant's physician or other certifying
20 practitioner.;
21 b. The applicant or the applicant's parent or
22 guardian.; and
23 c. The employee of the department's authorized agent
24 which employee is processing the application.
25 (9) A violation of this section is grounds for
26 disciplinary action under s. 458.331, s. 459.015, s. 460.413,
27 or s. 461.013, s. 463.016, or s. 464.018, as applicable.
