11  The Committee on Ways and Means (Clary and Crist) recommended
12  the following amendment:
13  
14         Senate Amendment 
15         On page 41, line 26, through page 43, line 2, delete
16  those lines
17  
18  and insert:  
19         Section 5.  (1)  For fiscal year 2005-2006, 46
20  full-time equivalent positions, with associated salary rate of
21  1,815,525, are authorized and the sums of $682,584 in
22  recurring funds and $1,164,135 in nonrecurring funds from the
23  Pari-mutuel Wagering Trust Fund and $139,472 in recurring and
24  $809,868 in nonrecurring funds from the Administrative Trust
25  Fund within the Department of Business and Professional
26  Regulation are appropriated for the purpose of carrying out
27  all regulatory activities provided in this act. The Executive
28  Office of the Governor shall place these funds, positions and
29  the salary rate in reserve until such time as the Department
30  of Business and Professional Regulation submits an expenditure
31  plan for approval to the Executive Office of the Governor and

 1  the chair and vice chair of the Legislative Budget Commission
 2  in accordance with the provisions of s. 216.177, Florida
 3  Statutes.
 4         (2)  For fiscal year 2005-2006, the sums of $1,024,998
 5  in recurring funds and $1,184,564 in nonrecurring funds are
 6  appropriated from the Pari-mutuel Wagering Trust Fund in the
 7  Department of Business and Professional Regulation for
 8  transfer to the Operating Trust Fund in the Department of Law
 9  Enforcement for the purposes of this act.  Thirty-nine
10  full-time equivalent positions with associated salary rate of
11  1,682,034, are authorized and the sums of $1,024,998 in
12  recurring funds and $1,184,564 in nonrecurring funds are
13  hereby appropriated from the Operating Trust Fund in the
14  Department of Law Enforcement for the purposes of
15  investigations, intelligence gathering, background
16  investigations, and any other responsibilities as provided for
17  in this act.  The Executive Office of the Governor shall place
18  these funds, positions and the salary rate in reserve until
19  such time as the Department of Law Enforcement submits an
20  expenditure plan for approval to the Executive Office of the
21  Governor and the chair and vice chair of the Legislative
22  Budget Commission in accordance with the provisions of s.
23  216.177, Florida Statutes.
24         (3)  The sum of $1 million in recurring funds is
25  appropriated for fiscal year 2005-2006 from the Pari-mutuel
26  Wagering Trust Fund within the Department of Business and
27  Professional Regulation from revenues received pursuant to s.
28  551.118, Florida Statutes, for contract services for
29  compulsive or addictive gambling prevention activities.
