3     Amendment (with title amendment)
4     Between lines 99 and 100 insert:
5     Section 2.  Paragraph (e) is added to subsection (2) of
6section 464.019, Florida Statutes, and section (6) of that
7section is amended to read:
8     464.019  Approval of nursing programs.--
9     (2)
10     (e)1.  Nursing faculty shall hold a current, active, and
11unencumbered registered nurse license or privilege to practice
12and meet state requirements.
13     2.  Clinical faculty shall hold a license or privilege to
14practice and meet state requirements.
15     3.  Nursing faculty who teach in a program leading to
16licensure as a practical nurse shall:
17     a.  Have a minimum of a baccalaureate degree with 40
18percent of faculty having a bachelors degree in nursing. All
19faculty must be able to demonstrate a theoretical and clinical
20competence for each assigned area of instruction.
21     b.  Have a total of 5 years of acute care experience, at
22least 3 years of which must have occurred within the 3 years
23preceding the appointment.
24     4.  Nursing faculty who teach in a program leading to
25licensure as a registered nurse shall:
26     a.  Have a minimum of a master's degree with 40 percent of
27faculty having a master's degree in nursing. All faculty must be
28able to demonstrate theoretical and clinical competence.
29     b.  Have a total of 5 years of acute care experience, at
30least 3 years of which must have occurred within the 3 years
31preceding the appointment.
32     (6)  Any nursing program that maintains accreditation
33through a nursing accrediting body recognized by the United
34States Department of Education shall be exempt from the rules of
35the board except as provided in paragraphs (2)(b) and (e)
36paragraph (2)(b), provided such exemption shall apply only to
37the extent the program maintains a student pass rate on the
38National Clinical Licensure Examination of not less than 10
39percentage points below the national average pass rate as
40reported annually by the National Council of State Boards of
41Nursing.
