11 The Committee on Community Affairs (Bennett) recommended the
12 following amendment:

15 On page 6, line 22, through
16 page 7, line 4, delete those lines

18 and insert:
19 (d) The determination of the Administration Commission
20 as to whether substantial progress has been made toward
21 accomplishing the tasks of the work program may be judicially
22 reviewed pursuant to chapter 86. All proceedings shall be
23 conducted in the circuit court where the Administration
24 Commission maintains its headquarters and shall be initiated
25 within 30 days after rendition of the Administration
26 Commission's determination. The Administration Commission's
27 determination as to whether substantial progress has been made
28 toward accomplishing the tasks of the work program shall be
29 upheld if it is fairly debatable and shall not be subject to
30 administrative review under chapter 120.

1 critical state concern, the state land planning agency shall
2 review proposed local comprehensive plans, and any amendments
3 to existing comprehensive plans, which are applicable to the
4 Florida Keys Area, the boundaries of which were described in
5 chapter 28-29, Florida Administrative Code, as of January 1,
6 2006, for compliance with subparagraphs 1. and 2., in addition
7 to reviewing proposed local comprehensive plans and amendments
8 for compliance as defined in s. 163.3184. All procedures and
9 penalties described in s. 163.3184 apply to the review
10 conducted pursuant to this paragraph.
11 1. Adoption of construction schedules for wastewater
12 facilities improvements in the annually adopted capital
13 improvements element and adoption of standards for the
14 construction of wastewater treatment facilities which meet or
15 exceed the criteria of chapter 99-395, Laws of Florida.
16 2. Adoption of goals, objectives, and policies to
17 protect public safety and welfare in the event of a natural
18 disaster by maintaining a hurricane evacuation clearance time
19 for permanent residents of no more than 24 hours. The
20 hurricane evacuation clearance time shall be determined by a
21 hurricane evacuation study conducted in accordance with a
22 professionally accepted methodology and approved by the state
23 land planning agency. The state land planning agency,
