3     Amendment to Amendment (074037) (with title amendment)
4Between lines 4305 and 4306, insert:
5     Section 29.  Subsection (11) is added to section 624.424,
6Florida Statutes, to read:
7     624.424  Annual statement and other information.--
8     (11)(a)  Any filing required to be submitted to the office
9by a property insurer under this section or under s. 624.413, s.
10627.062(2)(b), or s. 624.448 shall include a statement of
11certification signed under oath by the chief executive officer
12and the chief financial officer of the insurer certifying that
13the business and financial data provided in conjunction with
14such filing fairly represents in all material respects the true
15and accurate financial condition of the insurer's business
16operations. The office shall disregard and return, without
17prejudice for refiling, any filing made by an insurer that does
18not include the sworn statements of certification required by
19this subsection.
20     (b)  A person signing a statement of certification as
21required by this subsection in conjunction with the submission
22of a filing known by such person to materially misrepresent the
23business or financial condition of the insurer constitutes a
24felony of the third degree, punishable as provided in s.
25775.082, s. 775.083, or s. 775.084. Willfully falsifying any
26business or financial data of an insurer with the intent of
27materially misrepresenting an insurer's business or financial
28condition in any filing subject to the statement of
29certification requirement of this subsection constitutes a
30felony of the first degree, punishable as provided in s.
31775.082, s. 775.083, or s. 775.084.
