A bill to be entitled
2An act relating to the Charter Schools Capital Outlay
3Trust Fund; creating s. 1013.625, F.S.; creating the
4Charter Schools Capital Outlay Trust Fund in the
5Department of Education; providing for administration of
6the trust fund and use of moneys therein; requiring
7balances to remain in the trust fund; providing for future
8review and termination or re-creation of the trust fund;
9providing a contingent effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 1013.625, Florida Statutes, is created
14to read:
15     1013.625  Charter Schools Capital Outlay Trust Fund.--
16     (1)  The Charter Schools Capital Outlay Trust Fund is
17created within the Department of Education. Funds credited to
18the trust fund shall consist of revenues collected from the levy
19of nonrecurring taxes under s. 199.133. The trust fund shall be
20administered by the department and used to allocate capital
21outlay funds for charter schools eligible for funding under s.
221013.62(1).
23     (2)  Notwithstanding s. 216.301 and pursuant to s. 216.351,
24any balance in the trust fund at the end of any fiscal year
25shall remain in the trust fund and be available for carrying out
26the purposes of the trust fund.
27     (3)  Pursuant to the provisions of s. 19(f)(2), Art. III of
28the State Constitution, the trust fund shall, unless terminated
29sooner, be terminated July 1, 2011. Prior to its scheduled
30termination, the trust fund shall be reviewed as provided in s.
31215.3206(1) and (2).
32     Section 2.  This act shall take effect July 1, 2007, if
33House Bill 1203 or similar legislation is adopted in the same
34legislative session or an extension thereof and becomes law.
