1 A bill to be entitled
2 An act relating to motor vehicles; amending s.
3 320.0863, F.S.; providing definitions;
4 providing for the registration of custom
5 vehicles and street rods; providing
6 registration and equipment requirements for
7 such vehicles; exempting such vehicles from
8 certain equipment and inspection requirements;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 320.0863, Florida Statutes, is
14 amended to read:
15 (Substantial rewording of section. See
16 s. 320.0863, F.S., for present text.)
17 320.0863 Custom vehicles and street rods; registration
18 and license plates.--
19 (1) As used in this section, the term:
20 (a) "Blue dot tail light" means a red lamp that
21 contains a blue or purple insert that is not more than one
22 inch in diameter and is installed in the rear of a motor
23 vehicle.
24 (b) "Custom vehicle" means a motor vehicle that:
25 1. Is 25 years old or older and of a model year after
26 1948 or was manufactured to resemble a vehicle that is 25
27 years old or older and of a model year after 1948; and
28 2. Has been altered from the manufacturer's original
29 design or has a body constructed from nonoriginal materials.
30 (c) "Street rod" means a motor vehicle that:

1 1. Is of a model year of 1948 or older or was
2 manufactured after 1948 to resemble a vehicle of a model year
3 of 1948 or older; and
4 2. Has been altered from the manufacturer's original
5 design or has a body constructed from nonoriginal materials.
6 (2)(a) The model year and year of manufacture which
7 the body of a custom vehicle or street rod resembles is the
8 model year and year of manufacture listed on the certificate
9 of title, regardless of when the vehicle was actually
10 manufactured.
11 (b) The model year and year of manufacture on the
12 certificate of title shall include the capital letter "R"
13 following the year to indicate that the vehicle is a
14 reproduction or complete rebuild.
15 (3) To register a street rod or custom vehicle, the
16 owner shall apply to the department by submitting a completed
17 application form and providing:
18 (a) The license tax prescribed by s. 320.08(2)(a) and
19 a processing fee of $3;
20 (b) A written statement that the vehicle will not be
21 used for general daily transportation but will be maintained
22 for occasional transportation, exhibitions, club activities,
23 parades, tours, or other functions of public interest and
24 similar uses; and
25 (c) Written proof that the vehicle meets state
26 equipment and safety requirements for motor vehicles. However,
27 the vehicle must meet only the requirements that were in
28 effect in this state as a condition of sale in the year listed
29 as the model year on the certificate of title.
30 (4) The registration numbers and special license
31 plates assigned to such vehicles shall run in a separate

1 series, commencing with "Custom Vehicle 1" or "Street Rod 1,"
2 respectively, and the plates shall be of a distinguishing
3 color and design.
4 (5)(a) A vehicle registered under this section is
5 exempt from any law or local ordinance that requires periodic
6 vehicle inspections or the use and inspection of emission
7 controls.
8 (b) Such vehicle may also be equipped with blue dot
9 tail lights for stop lamps, rear turning indicator lamps, rear
10 hazard lamps, and rear reflectors.
11 Section 2. This act shall take effect July 1, 2007.

14 SENATE SUMMARY
15 Defines the terms "custom vehicle" and "street rod" and
provides for the registration and licensing of such
16 vehicles. Exempts such vehicles from certain equipment
and inspection requirements.
