1 A bill to be entitled
2 An act relating to labor organizations;
3 creating s. 447.3075, F.S.; requiring that the
4 officers of certain state law enforcement
5 agencies be in a separate bargaining unit;
6 providing guidelines for establishing such
7 separate unit; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 447.3075, Florida Statutes, is
12 created to read:
13 447.3075 Law enforcement bargaining units; separate
14 units required; establishment.--
15 (1) Notwithstanding any other provision of law,
16 administrative rule, or decision to the contrary, any state
17 law enforcement agency that has 1,200 or more officers shall
18 be in a bargaining unit that is separate from officers in
19 other state law enforcement agencies. If the application of
20 this subsection requires that a new state law enforcement
21 bargaining unit be created, a question concerning
22 representation is not deemed to have arisen regarding the new
23 unit or the existing unit.
24 (2) Upon appropriate petition, a representation
25 election to determine the bargaining representative for the
26 new unit shall be held notwithstanding any contract that
27 prohibits such election. After the initial election for the
28 new unit is conducted, all statutory election and contract
29 provisions shall apply.
30 Section 2. This act shall take effect July 1, 2007.
