| 2 | An act relating to regional workforce boards; amending s. |
| 3 | 445.007, F.S.; providing that undisbursed funds, including |
| 4 | accruing interest, in the accounts of such boards do not |
| 5 | revert at the end of a fiscal year but remain in the |
| 6 | accounts for use by the boards for implementing programs |
| 7 | for which the funds were intended; providing an effective |
| 8 | date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Subsection (8) of section 445.007, Florida |
| 13 | Statutes, is amended to read: |
| 14 | 445.007 Regional workforce boards.-- |
| 15 | (8) For purposes of procurement, regional workforce boards |
| 16 | and their administrative entities are not state agencies and are |
| 17 | exempt from chapters 120 and 287. The regional workforce boards |
| 18 | shall apply the procurement and expenditure procedures required |
| 19 | by federal law for the expenditure of federal funds. Regional |
| 20 | workforce boards, their administrative entities, committees, and |
| 21 | subcommittees, and other workforce units may authorize |
| 22 | expenditures to award suitable framed certificates, pins, or |
| 23 | other tokens of recognition for performance by units of the |
| 24 | workforce system. Regional workforce boards; their |
| 25 | administrative entities, committees, and subcommittees; and |
| 26 | other workforce units may authorize expenditures for promotional |
| 27 | items, such as t-shirts, hats, or pens printed with messages |
| 28 | promoting Florida's workforce system to employers, job seekers, |
| 29 | and program participants. However, such expenditures are subject |
| 30 | to federal regulations applicable to the expenditure of federal |
| 31 | funds. All contracts executed by regional workforce boards must |
| 32 | include specific performance expectations and deliverables. |
| 33 | Notwithstanding s. 216.301 and pursuant to s. 216.351, any |
| 34 | undisbursed balance remaining in the accounts of regional |
| 35 | workforce boards and interest accruing to such accounts not |
| 36 | distributed at the end of the fiscal year shall remain in the |
| 37 | account of each regional workforce board and shall increase the |
| 38 | total funds available to implement the programs for which the |
| 39 | funds were intended. |
| 40 | Section 2. This act shall take effect upon becoming a law. |
