A bill to be entitled
2An act relating to limited licenses; amending s. 626.321,
3F.S.; providing for limited licenses to transact travel
4protection insurance; specifying authorized entities;
5specifying applicable coverage; providing limitations;
6providing entity training requirements; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Paragraph (c) of subsection (1) of section
12626.321, Florida Statutes, is amended to read:
13     626.321  Limited licenses.--
14     (1)  The department shall issue to a qualified individual,
15or a qualified individual or entity under paragraphs (c), (d),
16(e), and (i), a license as agent authorized to transact a
17limited class of business in any of the following categories:
18     (c)  Personal accident or travel protection
19insurance.--License covering only policies of personal accident
20or travel protection insurance covering the risks of travel,
21except as provided in subparagraphs subparagraph 2. and 3. The
22license may be issued only:
23     1.  To a full-time salaried employee of a common carrier or
24a full-time salaried employee or owner of a transportation
25ticket agency and may authorize the sale of such ticket policies
26only in connection with the sale of transportation tickets, or
27to the full-time salaried employee of such an agent. No such
28policy shall be for a duration of more than 48 hours or for the
29duration of a specified one-way trip or round trip.
30     2.  To a full-time salaried employee of a business which
31offers motor vehicles for rent or lease, or to a business entity
32which offers motor vehicles for rent or lease. A business office
33licensed or a person licensed pursuant to this subparagraph may,
34as an agent of an insurer, transact insurance that provides
35coverage for accidental personal injury or death of the lessee
36and any passenger who is riding or driving with the covered
37lessee in the rental motor vehicle if the lease or rental
38agreement is for not more than 30 days, or if the lessee is not
39provided coverage for more than 30 consecutive days per lease
40period; however, if the lease is extended beyond 30 days, the
41coverage may be extended one time only for a period not to
42exceed an additional 30 days.
43     3.  To an entity that is:
44     a.  The developer of a timeshare plan that is the subject
45of an approved public offering statement under chapter 721;
46     b.  An exchange company operating an exchange program
47approved under chapter 721;
48     c.  A managing entity operating a timeshare plan approved
49under chapter 721;
50     d.  A seller of travel as defined in chapter 559; or
51     e.  A subsidiary or affiliate of any of the entities
52described in sub-subparagraphs a.-d.

54Any entity licensed pursuant to this subparagraph and its
55employees, as the agent of an insurer, may offer policies or
56certificates of insurance that provide coverage for risks of
57travel, including, but not limited to, accidental death and
58dismemberment; trip cancellation, interruption, or delay; loss
59of or damage to personal effects or travel documents; baggage
60delay; emergency medical travel or evacuation; and medical,
61surgical, and hospital expenses of a traveler related to an
62illness or emergency that are incidental to planned travel or
63accommodations. Any such policy or certificate may be issued for
64terms longer than 60 days but each policy or certificate shall
65be limited to coverage for travel or use of accommodations of no
66longer than 60 days. The provisions of this chapter requiring
67submission of fingerprints do not apply to entities licensed
68under this subparagraph. The employee of a licensee who offers
69policies or certificates under this subparagraph must receive
70initial training from a general lines agent or an insurer
71authorized under chapter 624 to transact insurance within this
72state.
73     Section 2.  This act shall take effect July 1, 2007.
