  1                      A bill to be entitled

  2         An act relating to female genital mutilation;

  3         creating s. 794.08, F.S.; defining the term

  4         "female genital mutilation"; providing that a

  5         person who commits female genital mutilation

  6         upon a female younger than 18 years of age

  7         commits a felony of the first degree; providing

  8         that a person who removes, or causes or permits

  9         the removal of, a female younger than 18 years

10         of age from this state for the purpose of

11         committing female genital mutilation commits a

12         felony of the second degree; providing that a

13         parent or guardian who consents to the female

14         genital mutilation of his or her female child

15         who is younger than 18 years of age commits a

16         felony of the first degree; providing that the

17         act does not apply with respect to certain

18         medical procedures that are conducted by health

19         professionals to preserve the health of the

20         female; providing that consent is not a defense

21         to the offense of female genital mutilation;

22         amending s. 921.0022, F.S.; creating felony

23         classifications in the offense severity ranking

24         chart of the Criminal Punishment Code for

25         specified violations; providing an effective

26         date.

28  Be It Enacted by the Legislature of the State of Florida:

30         Section 1.  Section 794.08, Florida Statutes, is

31  created to read:

 1         794.08  Female genital mutilation.--

 2         (1)  As used in this section, the term "female genital

 3  mutilation" means the circumcising, excising, or infibulating,

 4  in whole or in part, the labia majora, labia minora, or

 5  clitoris of a female person.

 6         (2)  A person who knowingly commits, or attempts to

 7  commit, female genital mutilation upon a female person younger

 8  than 18 years of age commits a felony of the first degree,

 9  punishable as provided in s. 775.082, s. 775.083, or s.

10  775.084.

11         (3)  A person who knowingly removes, or causes or

12  permits the removal of, a female person younger than 18 years

13  of age from this state for purposes of committing female

14  genital mutilation commits a felony of the second degree,

15  punishable as provided in s. 775.082, s. 775.083, or s.

16  775.084.

17         (4)  A person who is a parent, a guardian, or in a

18  position of familial or custodial authority to a female person

19  younger than 18 years of age and who knowingly consents to or

20  permits the female genital mutilation of that female person

21  commits a felony of the third degree, punishable as provided

22  in s. 775.082, s. 775.083, or s. 775.084.

23         (5)  This section does not apply to procedures

24  performed by or under the direction of a physician licensed

25  under chapter 458, an osteopathic physician licensed under

26  chapter 459, a registered nurse licensed under part I of

27  chapter 464, a practical nurse licensed under part I of

28  chapter 464, an advanced registered nurse practitioner

29  licensed under part I of chapter 464, a midwife licensed under

30  chapter 467, or a physician assistant licensed under chapter

31  458 or chapter 459 when necessary to preserve the physical

 1  health of a female person. This section also does not apply to

 2  any autopsy or limited dissection conducted pursuant to

 3  chapter 406.

 4         (6)  Consent of a female person younger than 18 years

 5  of age or the consent of a parent, guardian, or person who is

 6  in a position of familial or custodial authority to the female

 7  person younger than 18 years of age is not a defense to the

 8  offense of female genital mutilation.

 9         Section 2.  Paragraphs (g), (h), and (i) of subsection

10  (3) of section 921.0022, Florida Statutes, are amended to

11  read:
