The Committee on Education Pre-K - 12 (Wise) recommended the

following amendment:

     Delete everything after the enacting clause and insert:

     Be It Enacted by the Legislature of the State of Florida:

7

     Section 1.  Subsection (5) of section 1006.06, Florida

9

Statutes, is amended to read:

10

     1006.06  School food service programs.--

11

     (5)(a)  Each district school board shall implement school

12

breakfast programs in all elementary schools that make breakfast

13

available to all students in the schools. kindergarten through

14

grade 6 in each district school, unless the elementary school

15

goes only through grade 5, in which case the requirement shall

16

apply only through grade 5. Each district school board shall

17

implement breakfast programs in all elementary schools in which

18

students are eligible for free and reduced price lunch meals, to

19

the extent specifically funded in the General Appropriations Act.

20

Each district school board is encouraged to expand its school

21

breakfast programs to make breakfast available to all students in

22

its middle and high schools.

23

     (b) Beginning in the 2008-2009 school year:

24

     1. Each district school board is encouraged to make

25

available universal free breakfast to eligible students in each

26

elementary, middle, and high school in which 80 percent or more

27

of students are eligible for free or reduced-price meals.

28

     2. Elementary, middle, and high school students in these

29

schools shall annually receive information prepared by the

30

district's food service administration regarding the school

31

breakfast program. The information shall be communicated through

32

school announcements and written notice sent to all parents.

33

     (c) A district school board may operate a breakfast program

34

providing for food preparation at the school site or in central

35

locations with distribution to designated satellite schools or

36

any combination thereof.

     (d)(b) The commissioner shall make every reasonable effort

38

to ensure that any school designated a "severe need school"

39

receives the highest rate of reimbursement to which it is

40

entitled pursuant to 42 U.S.C. s. 1773 for each free and reduced

41

price breakfast served.

     (e)(c) The department shall calculate and distribute a

43

school district breakfast supplement for each school year by

44

multiplying the state breakfast rate as specified in the General

45

Appropriations Act by the number of free and reduced price

46

breakfast meals served.

47

     (f) The department is encouraged to develop, with national

48

breakfast foundations and the Department of Agriculture, a cost-

49

efficient incentive model to encourage school districts to expand

50

student participation in school breakfast programs. The cost

51

efficient expansion model shall be developed with the use of

52

existing funds and those funds made available from private

53

organizations and foundations.

     (g)(d) The Legislature shall provide sufficient funds in

55

the General Appropriations Act to reimburse participating school

56

districts for the difference between the average federal

57

reimbursement for free and reduced price breakfasts and the

58

average statewide cost for breakfasts.

     Section 2.  This act shall take effect July 1, 2008.
