A bill to be entitled
2An act relating to interscholastic sports; providing a
3short title; amending s. 1006.15, F.S.; revising the
4criteria under which a charter school student may
5participate in interscholastic extracurricular activities
6of a public school; providing for certain private school
7students to participate in interscholastic sports at a
8public school under certain conditions; providing
9criteria; providing for a public school student to
10participate in interscholastic sports at another public
11school; providing criteria; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  This act may be cited as "Erin's Law."
16     Section 2.  Paragraph (d) of subsection (3) of section
171006.15, Florida Statutes, is amended, and paragraphs (e) and
18(f) are added to that subsection, to read:
19     1006.15  Student standards for participation in
20interscholastic extracurricular student activities;
21regulation.--

23     (d)  An individual charter school student pursuant to s.
241002.33 is eligible to participate at the public school to which
25the student would be assigned according to district school board
26attendance area policies or which the student could choose to
27attend, pursuant to district or interdistrict controlled open-
28enrollment provisions, in any interscholastic extracurricular
29activity of that school, unless such activity is provided by the
30student's charter school, if the following conditions are met:
31     1.  The charter school student must meet the requirements
32of the charter school education program as determined by the
33charter school governing board.
34     2.  During the period of participation at a school, the
35charter school student must demonstrate educational progress by
36maintaining the grade point average required by this section and
37passing each class for which he or she is enrolled as required
38in paragraph (b).
39     3.  The charter school student must meet the same residency
40requirements as other students in the school at which he or she
41participates.
42     4.  The charter school student must meet the same standards
43of acceptance, behavior, and performance that are required of
44other students in extracurricular activities.
45     5.  The charter school student must register with the
46school his or her intent to participate in interscholastic
47extracurricular activities as a representative of the school
48before the beginning date of the season for the activity in
49which he or she wishes to participate. A charter school student
50must be able to participate in curricular activities if that is
51a requirement for an extracurricular activity.
52     6.  A student who transfers from a charter school program
53to a traditional public school before or during the first
54grading period of the school year is academically eligible to
55participate in interscholastic extracurricular activities during
56the first grading period if the student has a successful
57evaluation from the previous school year, pursuant to
58subparagraph 2.
59     7.  Any public school or private school student who has
60been unable to maintain academic eligibility for participation
61in interscholastic extracurricular activities is ineligible to
62participate in such activities as a charter school student until
63the student has successfully completed one grading period in a
64charter school pursuant to subparagraph 2. to become eligible to
65participate as a charter school student.
66     (e)  A private school student is eligible to participate in
67interscholastic sports at the public school to which the student
68would be assigned according to the district school board's
69attendance area policies or at a public school that the student
70could choose to attend under district or interdistrict
71controlled open enrollment provisions if all of the following
72conditions are met:
73     1.  The private school student meets the requirements of
74the private school program pursuant to s. 1002.42.
75     2.  The private school in which the student is enrolled
76does not offer the interscholastic sports in which the student
77would participate at the public school.
78     3.  During the period of participation at the public
79school, the private school student demonstrates educational
80progress by maintaining the grade point average required by this
81section and passing each class for which he or she is enrolled
82in the private school program as confirmed by a transcript from
83the private school. If the private school student is unable to
84maintain academic eligibility for participating in
85interscholastic sports, the student is ineligible to participate
86in such activities until he or she successfully completes one
87grading period in all subjects taken in the private school
88program.
89     4.  The private school student meets the same residency
90requirements as other students in the school at which he or she
91participates.
92     5.  The private school student meets the same standards of
93acceptance, behavior, and performance as required of other
94students participating in interscholastic sports at the public
95school.
96     6.  The private school student registers with the public
97school his or her intent to participate in interscholastic
98sports as a representative of the school before the beginning
99date of the season for the activity in which he or she wishes to
100participate; however, the private school student must be able to
101participate in curricular activities if that is a requirement
102for interscholastic sports. A student who transfers from a
103private school program to a public school before or during the
104first grading period of the school year is academically eligible
105to participate in interscholastic sports during the first
106grading period if the student meets the requirements of
107subparagraph 3. from the previous school year.
108     7.  The private school in which the student is enrolled
109provides an affidavit to the public school which states that the
110private school:
111     a.  Does not offer the interscholastic sports in which the
112student would participate at the public school; and
113     b.  Did not offer the interscholastic sports in which the
114student would participate in during the prior academic year.
115     (f)  A public school student is eligible to participate at
116another public school in the student's school attendance area in
117any interscholastic sports of that school if all of the
118following conditions are met:
119     1.  The public school in which the student is enrolled does
120not offer the interscholastic sports in which the student would
121participate at the public school.
122     2.  During the period of participation at the school, the
123student demonstrates educational progress as required in
124paragraph (a).
125     3.  The public school in which the student is enrolled is
126in the same school district as that in which the student intends
127to participate in the interscholastic sports under this section.
128     4.  The student meets the same standards of acceptance,
129behavior, and performance as required of other students in
130interscholastic sports.
131     5.  The student registers with the school his or her intent
132to participate in interscholastic sports as a representative of
133the school before the beginning date of the season for the
134activity in which he or she wishes to participate. A student
135must be able to participate in curricular activities if that is
136a requirement for interscholastic sports.
137     6.  A student who transfers from the school in which he or
138she is enrolled to another public school before or during the
139first grading period of the school year is academically eligible
140to participate in interscholastic sports during the first
141grading period if the student has a successful evaluation from
142the previous school year pursuant to subparagraph 2.
143     7.  Any public school student who has been unable to
144maintain academic eligibility for participation in
145interscholastic sports is ineligible to participate in such
146activities until the student has successfully completed one
147grading period in the student's home school pursuant to
148subparagraph 2. to become eligible to participate.
149     Section 3.  This act shall take effect July 1, 2008.
