2An act relating to trust funds; creating s. 445.061, F.S.;
3creating the Florida Business and Workforce
4Competitiveness Trust Fund within the Agency for Workforce
5Innovation; providing for sources of funds and purposes;
6providing for annual carryforward of funds; providing for
7future review and termination or re-creation of the trust
8fund; providing a contingent effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Section 445.061, Florida Statutes, is created
13to read:
14     445.061  Florida Business and Workforce Competitiveness
15Trust Fund.--
16     (1)  The Florida Business and Workforce Competitiveness
17Trust Fund is created within the Agency for Workforce Innovation
18and shall be administered by the regional workforce boards, as
19defined in s. 445.007, upon allocation by Workforce Florida,
20Inc. Funds credited to the trust fund shall consist of
21employment training investment assessments from employer
22contributions under s. 443.131.
23     (2)  The trust fund is established for use as a depository
24for funds to be used for the purposes of the Florida Business
25and Workforce Competitiveness Program established in s. 445.06.
26     (3)  Notwithstanding s. 216.301 and pursuant to s. 216.351,
27any balance in the trust fund at the end of any fiscal year
28shall remain in the trust fund at the end of the year and shall
29be available for carrying out the purpose of the trust fund.
30     (4)  In accordance with s. 19(f)(2), Art. III of the State
31Constitution, the Florida Business and Workforce Competitiveness
32Trust Fund shall, unless terminated sooner, be terminated on
33July 1, 2012. Before its scheduled termination, the trust fund
34shall be reviewed as provided in s. 215.3206(1) and (2).
35     Section 2.  This act shall take effect July 1, 2008, if
36House Bill 1505, or similar legislation, is adopted in the same
37legislative session or an extension thereof and becomes law.
