An act relating to Hillsborough County; amending chapter

2004-414, Laws of Florida, relating to projects for which

4

payment and performance bonds may be waived for the

5

construction of a public building, for the prosecution and

6

completion of a public work, or for repairs on a public

7

building under certain circumstances; increasing the

8

number of such projects on which a small business may

9

successfully bid before becoming ineligible for certain

10

additional bidding; extending the sunset date of chapter

11

2004-414, Laws of Florida; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

14

     Section 1.  Sections 5 and 7 of chapter 2004-414, Laws of

16

Florida, are amended to read:

17

     Section 5.  A small business that has been the successful

18

bidder on five three projects where the payment and performance

19

bond were waived pursuant to section 1 shall be ineligible to bid

20

on additional projects where the payment and performance bond has

21

been waived on projects with an estimated value of not less than

22

$200,000 and not exceeding $500,000. The local small business may

23

continue to participate in other elements of the economic

24

development program for local small business so long as otherwise

25

eligible.

     Section 7.  This act shall stand repealed on September 30,

27

2011 2009.

     Section 2.  This act shall take effect upon becoming a law.
