A bill to be entitled

An act relating to the disposition of traffic infractions;

3

amending s. 318.18, F.S.; requiring that revenue from the

4

surcharge imposed for certain criminal traffic offenses

5

and all noncriminal traffic violations be remitted to the

6

Department of Revenue, deposited quarterly into the State

7

Agency Law Enforcement Radio System Trust Fund of the

8

Department of Management Services, and be used for certain

9

purposes; authorizing the Department of Management

10

Services to retain funds from such revenue to recover

11

certain costs and expenses; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

14

     Section 1.  Subsection (17) of section 318.18, Florida

16

Statutes, is amended to read:

     318.18  Amount of penalties.--The penalties required for a

18

noncriminal disposition pursuant to s. 318.14 or a criminal

19

offense listed in s. 318.17 are as follows:

20

     (17)  In addition to any penalties imposed, a surcharge of

21

$3 must be paid for all criminal offenses listed in s. 318.17 and

22

for all noncriminal moving traffic violations under chapter 316.

Revenue from the surcharge shall be remitted to the Department of

24

Revenue and deposited quarterly into the State Agency Law

25

Enforcement Radio System Trust Fund of the Department of

26

Management Services for the state agency law enforcement radio

27

system, as described in s. 282.1095, and to provide technical

28

assistance to state agencies and local law enforcement agencies

29

with their statewide systems of regional law enforcement

30

communications, as described in s. 282.111. This subsection

31

expires July 1, 2012. The Department of Management Services may

32

retain funds sufficient to recover the costs and expenses

33

incurred for the purposes of managing, administering, and

34

overseeing the Statewide Law Enforcement Radio System, and

35

providing technical assistance to state agencies and local law

36

enforcement agencies with their statewide systems of regional law

37

enforcement communications. The Department of Management Services

38

working in conjunction with the Joint Task Force on State Agency

39

Law Enforcement Communications shall determine and direct the

40

purposes for which these funds are used to enhance and improve

41

the radio system.

     Section 2.  This act shall take effect July 1, 2008.
