A bill to be entitled
2An act relating to public school student health services;
3amending s. 1006.062, F.S.; providing that a district
4school board may authorize a school nurse to maintain
5supplies of prefilled epinephrine auto-injectors at
6schools in the school district; providing requirements for
7prescriptions; authorizing use for emergency treatment;
8amending s. 1002.20, F.S.; correcting a cross-reference;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsections (6) and (7) of section 1006.062,
14Florida Statutes, are renumbered as subsections (7) and (8),
15respectively, and a new subsection (6) is added to that section
16to read:
17     1006.062  Administration of medication and provision of
18medical services by district school board personnel.--
19     (6)(a)  Each district school board may authorize a school
20nurse who is licensed under chapter 464 and is employed by the
21district school board to maintain at each school in the school
22district an adequate supply of prefilled auto-injectors of
23epinephrine with fifteen-hundredths milligram or three-tenths
24milligram delivery. The school nurse shall recommend to the
25district school board the number of prefilled epinephrine auto-
26injectors to be maintained at each school.
27     (b)  To obtain prefilled epinephrine auto-injectors for a
28school district, a written prescription from a physician or a
29physician assistant licensed under chapter 458 or chapter 459 or
30a nurse licensed under chapter 464 is required. The school
31nurse's name must appear on the prescription, the school
32district must be designated as the patient, and the prescription
33must be filled at a pharmacy licensed under chapter 465.
34     (c)  Based on a school nurse's training in recognizing an
35acute episode of an anaphylactic reaction, the school nurse
36shall have the discretion to use an epinephrine auto-injector on
37any student that he or she believes is having a life-threatening
38anaphylactic reaction.
39     Section 2.  Paragraph (e) of subsection (3) of section
401002.20, Florida Statutes, is amended to read:
41     1002.20  K-12 student and parent rights.--Parents of public
42school students must receive accurate and timely information
43regarding their child's academic progress and must be informed
44of ways they can help their child to succeed in school. K-12
45students and their parents are afforded numerous statutory
46rights including, but not limited to, the following:
47     (3)  HEALTH ISSUES.--
48     (e)  Contraceptive services to public school students.--In
49accordance with the provisions of s. 1006.062(8)(7), students
50may not be referred to or offered contraceptive services at
51school facilities without the parent's consent.
52     Section 3.  This act shall take effect July 1, 2008.
