A bill to be entitled
2An act relating to school food service programs; amending
3s. 1006.06, F.S.; requiring the expansion of school
4district breakfast programs to middle and high schools;
5specifying requirements for the provision of universal
6free school breakfast; providing procedures for school
7breakfast programs and requiring information to be
8communicated to students and parents; authorizing the
9Department of Education to develop an incentive program to
10encourage student participation; providing an effective
11date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Subsection (5) of section 1006.06, Florida
16Statutes, is amended to read:
17     1006.06  School food service programs.--
18     (5)(a)  Each district school board shall implement school
19breakfast programs in all elementary schools which shall that
20make breakfast available to all students in the schools. By the
21beginning of the 2010-2011 school year, each district school
22board shall expand its school breakfast programs to make
23breakfast available to all students in its middle and high
24schools. kindergarten through grade 6 in each district school,
25unless the elementary school goes only through grade 5, in which
26case the requirement shall apply only through grade 5. Each
27district school board shall implement breakfast programs in all
28elementary schools in which students are eligible for free and
29reduced price lunch meals, to the extent specifically funded in
30the General Appropriations Act.
31     (b)  By the beginning of the 2010-2011 school year:
32     1.  The district school board shall provide universal free
33breakfast to all students in each elementary, middle, and high
34school in which 80 percent or more of students are eligible for
35free or reduced-price meals, to the extent specifically funded
36in the General Appropriations Act. In these schools, at least 10
37percent of the breakfast meals shall be served at an alternative
38site location which may include, but not be limited to,
39"breakfast in the classroom," "Grab 'n' Go" breakfast, and
40"breakfast on the bus."
41     2.  All elementary, middle, and high school students shall:
42     a.  Have permission to visit a breakfast point-of-sale,
43receive a "Grab 'n' Go" breakfast, and eat the breakfast in the
44classroom for a period of time of at least 15 minutes after the
45first bell has rung if the school bus ridden by the student
46arrives late or for a reasonable period of time that enables the
47student to eat the breakfast if the school bus arrives after the
48first bell has rung.
49     b.  Annually receive information prepared by the district's
50food service administration regarding the school breakfast
51program. The information shall be communicated through school
52announcements and written notice sent to all parents.
53     (c)  A district school board may operate a breakfast
54program providing for food preparation at the school site or in
55central locations with distribution to designated satellite
56schools or any combination thereof.
57     (d)(b)  The commissioner shall make every reasonable effort
58to ensure that any school designated a "severe need school"
59receives the highest rate of reimbursement to which it is
60entitled pursuant to 42 U.S.C. s. 1773 for each free and reduced
61price breakfast served.
62     (e)(c)  The department shall calculate and distribute a
63school district breakfast supplement for each school year by
64multiplying the state breakfast rate as specified in the General
65Appropriations Act by the number of free and reduced price
66breakfast meals served.
67     (f)  The department may develop an incentive program for
68school districts to encourage the expansion of student
69participation in school breakfast programs through innovative
70means which may include, but not be limited to, rewarding
71schools that significantly increase student participation and
72schools that maintain a 75-percent student participation rate.
73To the extent specifically funded in the General Appropriations
74Act, funding shall be given to school districts according to the
75percentage of students serve.
76     (g)(d)  The Legislature shall provide sufficient funds in
77the General Appropriations Act to reimburse participating school
78districts for the difference between the average federal
79reimbursement for free and reduced price breakfasts and the
80average statewide cost for breakfasts.
81     Section 2.  This act shall take effect July 1, 2008.
