A bill to be entitled
2An act relating to persons injured by crime; providing a
3short title; creating s. 843.21, F.S.; prohibiting the
4depriving of a victim injured by a crime of medical
5treatment with specified intent; providing penalties;
6providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  This act may be cited as the "Pastora Pacheco
11Aid to Victims Act."
12     Section 2.  Section 843.21, Florida Statutes, is created to
13read:
14     843.21  Depriving crime victim of medical care.--A person
15who takes custody of or exercises control over a person he or
16she knows to be injured as a result of criminal activity and
17deprives that person of medical care with the intent to avoid,
18delay, hinder, or obstruct any investigation of the criminal
19activity contributing to the injury commits:
20     (1)  Where the victim's medical condition worsens as a
21result of the deprivation of medical care, a felony of the third
22degree, punishable as provided in s. 775.082, s. 775.083, or s.
23775.084.
24     (2)  Where deprivation of medical care contributes or
25results in the death of the victim, a felony of the second
26degree, punishable as provided in s. 775.082, s. 775.083, or s.
27775.084.
28     Section 3.  This act shall take effect October 1, 2008.
