A bill to be entitled
2An act relating to the practice of architecture and
3interior design; amending s. 481.203, F.S.; revising
4definitions of the terms "interior design" and "space
5planning" to exempt certain drawings and activities
6related to the manufacture, sale, and installation of
7commercial food service equipment, cubicle workstations,
8and similar modular furniture and fixtures from provisions
9regulating interior design; amending s. 481.229, F.S.;
10exempting certain persons engaged in the manufacture,
11sale, and installation of commercial food service
12equipment, cubicle workstations, and similar modular
13furniture and fixtures from provisions regulating
14architecture and interior design; providing an effective
15date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  Subsections (8) and (12) of section 481.203,
20Florida Statutes, are amended to read:
21     481.203  Definitions.--As used in this part:
22     (8)  "Interior design" means designs, consultations,
23studies, drawings, specifications, and administration of design
24construction contracts relating to nonstructural interior
25elements of a building or structure. The term "Interior design"
26includes, but is not limited to, reflected ceiling plans, space
27planning, furnishings, and the fabrication of nonstructural
28elements within and surrounding interior spaces of buildings.
29The term does not include related utility rough-in drawings,
30engineering drawings, and shop drawings to assist architects,
31engineers, interior designers, and general contractors; designs,
32consultations, studies, drawings, specifications, layouts, or
33floor plans prepared for the sale or installation of commercial
34food service equipment or cubicle workstations and similar
35modular furniture, shelving, cabinetry, and spatial dividers or
36partitions by the manufacturer of such equipment, furniture, or
37fixtures or the manufacturer's representative, distributor, or
38dealer, or an employee thereof; or "Interior design"
39specifically excludes the design of or the responsibility for
40architectural and engineering work, except for specification of
41fixtures and their location within interior spaces. As used in
42this subsection, "architectural and engineering interior
43construction relating to the building systems" includes, but is
44not limited to, construction of structural, mechanical,
45plumbing, heating, air-conditioning, ventilating, electrical, or
46vertical transportation systems, or construction which
47materially affects lifesafety systems pertaining to firesafety
48protection such as fire-rated separations between interior
49spaces, fire-rated vertical shafts in multistory structures,
50fire-rated protection of structural elements, smoke evacuation
51and compartmentalization, emergency ingress or egress systems,
52and emergency alarm systems.
53     (12)  "Space planning" means the analysis, programming, or
54design of spatial requirements, including preliminary space
55layouts and final planning. The term does not include designs,
56consultations, studies, drawings, specifications, layouts, or
57floor plans prepared for the sale or installation of commercial
58food service equipment or cubicle workstations and similar
59modular furniture, shelving, cabinetry, and spatial dividers or
60partitions by the manufacturer of such equipment, furniture, or
61fixtures or the manufacturer's representative, distributor, or
62dealer, or an employee thereof.
63     Section 2.  Paragraph (c) is added to subsection (6) of
64section 481.229, Florida Statutes, to read:
65     481.229  Exceptions; exemptions from licensure.--
66     (6)  This part shall not apply to:
67     (c)  A manufacturer of commercial food service equipment or
68cubicle workstations and similar modular furniture, shelving,
69cabinetry, and spatial dividers or partitions or the
70manufacturer's representative, distributor, or dealer, or an
71employee thereof, who prepares designs, consultations, studies,
72drawings, specifications, layouts, or floor plans for the sale
73or installation of such equipment, furniture, or fixtures or who
74advertises those services.
75     Section 3.  This act shall take effect July 1, 2009.
