A bill to be entitled
2An act relating to public K-12 educational instruction;
3amending s. 1003.46, F.S., relating to health education;
4deleting provisions that require schools to teach
5abstinence from sexual activity outside of marriage as the
6expected standard for all school-age students as part of
7instruction in human sexuality; providing an effective
8date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsection (2) of section 1003.46, Florida
13Statutes, is amended to read:
14     1003.46  Health education; instruction in acquired immune
15deficiency syndrome.--
16     (2)  Throughout instruction in acquired immune deficiency
17syndrome, sexually transmitted diseases, or health education,
18when such instruction and course material contains instruction
19in human sexuality, a school shall:
20     (a)  Teach abstinence from sexual activity outside of
21marriage as the expected standard for all school-age students
22while teaching the benefits of monogamous heterosexual marriage.
23     (a)(b)  Emphasize that abstinence from sexual activity is a
24certain way to avoid out-of-wedlock pregnancy, sexually
25transmitted diseases, including acquired immune deficiency
26syndrome, and other associated health problems.
27     (b)(c)  Teach that each student has the power to control
28personal behavior and encourage students to base actions on
29reasoning, self-esteem, and respect for others.
30     (c)(d)  Provide instruction and material that is
31appropriate for the grade and age of the student.
32     Section 2.  This act shall take effect July 1, 2009.
