    1                        A bill to be entitled                      
    2         An act relating to public records; providing an
    3         exemption from public-records requirements for
    4         information received from cable and video service
    5         providers by the Office of Program Policy Analysis and
    6         Government Accountability and all information
    7         collected and maintained by the office concerning the
    8         status of competition in the cable and video service
    9         industry; providing for future legislative review and
   10         repeal of the exemption under the Open Government
   11         Sunset Review Act; providing a statement of public
   12         necessity; providing a contingent effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Exemption from public-records law; reports on
   17  the status of competition in the cable and video service
   18  industry.—
   19         (1)All information received from cable and video service
   20  providers by the Office of Program Policy Analysis and
   21  Government Accountability and all information collected and
   22  maintained by the office concerning the status of competition in
   23  the cable and video service industry is confidential and exempt
   24  from public disclosure pursuant to s. 119.07(1), Florida
   25  Statutes, and Section 24(a), Article I of the State
   26  Constitution.
   27         (2)This section is subject to the Open Government Sunset
   28  Review Act in accordance with s. 119.15, Florida Statutes, and
   29  shall stand repealed on October 2, 2014, unless reviewed and
   30  saved from repeal through reenactment by the Legislature.
   31         Section 2. The Legislature finds that it is a public
   32  necessity to exempt from public disclosure all information
   33  received from cable and video service providers by the Office of
   34  Program Policy Analysis and Government Accountability which is
   35  used to determine the extent of competition in the cable and
   36  video service industry in this state in order to evaluate the
   37  effect of the recently enacted state-issued franchise on the
   38  industry's ability to provide cable or video service based on
   39  factors such as availability, price, and quality of service to
   40  customers.
   41         Section 3. This act shall take effect on the same date that
   42  Senate Bill ___ or similar legislation takes effect, if such
   43  legislation is enacted in the same legislative session, or an
   44  extension thereof, and becomes law.
