       The Committee on Banking and Insurance (Bennett) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 20 - 45
    4  and insert:
    5  equipment in response to a motor vehicle accident, except for
    6  transportation and treatment provided by ambulance services
    7  licensed pursuant to s. 401.23(5), or except when services
    8  provided to an insured are expressly covered by an insurance
    9  company and:
   10         (a)The insured is lawfully billed for the services or
   11  assigns the right to collect to the service provider; or
   12         (b)Services provided to the insured are expressly
   13  authorized by state or federal law to be billed directly to an
   14  insurance company.
   15         (2)As used in this section, the term “first responder”
   16  means a law enforcement officer as defined in s. 943.10, a
   17  firefighter as defined in s. 633.30, or an emergency medical
   18  technician or paramedic as defined in s. 401.23 who is employed
   19  by state or local government. A volunteer law enforcement
   20  officer, firefighter, or emergency medical technician or
   21  paramedic engaged by the state or a local government is also
   22  considered a first responder of the state or local government
   23  for purposes of this section.
   24         Section 2. Section 166.0446, Florida Statutes, is created
   25  to read:
   26         166.0446Prohibition of fees for first-responder services.—
   27         (1)A municipality may not impose a tax, charge a fee, or
   28  seek reimbursement for any costs or expenses that may be
   29  incurred for services provided by a first responder, including
   30  costs or expenses related to personnel, supplies, motor
   31  vehicles, or equipment in response to a motor vehicle accident,
   32  except for transportation and treatment provided by ambulance
   33  services licensed pursuant to s. 401.23(5), or except when
