4     Between lines 548 and 549, insert:
5     Section 6.  Paragraph (zzz) is added to subsection (4) of
6section 320.08056, Florida Statutes, to read:
7     320.08056  Specialty license plates.--
8     (4)  The following license plate annual use fees shall be
9collected for the appropriate specialty license plates:
10     (zzz)  Hispanics Settled Florida in 1565 license plate,
11$25.
12     Section 7.  Subsection (78) is added to section 320.08058,
13Florida Statutes, to read:
14     320.08058  Specialty license plates.--
15     (78)  HISPANICS SETTLED FLORIDA IN 1565 LICENSE PLATES.--
16     (a)  The department shall develop a Hispanics Settled
17Florida in 1565 license plate as provided in this section.
18     (b)  Hispanics Settled Florida in 1565 license plates must
19bear the colors and design approved by the department. The word
20"Florida" must appear at the top of the plate, and the words
21"HISPANICS SETTLED FLORIDA" must appear at the bottom of the
22plate.
23     (c)  The department shall retain all revenues from the sale
24of such plates until all startup costs for developing and
25issuing the plates have been recovered. Thereafter, 50 percent
26of the annual use fees shall be distributed to National Hispanic
27Corporate Achievers, Inc., an organization in Orlando that
28sponsors minority job fairs. The remaining 50 percent shall be
29distributed to Florida Hispanic Foundation. The fees shall be
30used to support job and mentorship programs and to provide
31scholarship grants for needy students from minority communities
32in this state.
33     (d)  By January 1, 2010, the department shall establish a
34method to issue a Hispanics Settled Florida in 1565 license
35plate voucher to allow for the presale of the Hispanics Settled
36Florida in 1565 license plate. Issuance of the vouchers is
37contingent upon payment of an application fee of $10,000 no
38later than December 1, 2009. The processing fee as prescribed in
39s. 320.08056, the service charge and branch charge as prescribed
40in s. 320.04, and the annual use fee as prescribed in s.
41320.08056 shall be charged for the voucher. All other applicable
42fees shall be charged at the time of issuance of the license
43plate. The approved Hispanics Settled Florida in 1565 license
44plate organization must, within 24 months after the
45establishment of the presale voucher, record with the department
46a minimum of 1,000 voucher sales before manufacture of the
47Hispanics Settled Florida in 1565 license plate can commence.
48If, at the conclusion of the 24-month presale period, the
49minimum sales requirements have not been met, the Hispanics
50Settled Florida in 1565 license plate is deauthorized and the
51department shall discontinue development of the plate and
52discontinue issuance of the presale vouchers as prescribed in s.
53320.08056. Upon deauthorization of the license plate, a
54purchaser of the Hispanics Settled Florida in 1565 license plate
55voucher may use the annual use fee collected as a credit towards
56any other specialty license plate or apply for a refund on a
57form prescribed by the department. This paragraph expires
58January 1, 2012.
