4     Remove everything after the enacting clause and insert:
5     Section 1.  Paragraph (cc) of subsection (4) of section
6320.08056, Florida Statutes, is amended, paragraphs (qqq)
7through (yyy) are added to that subsection, and subsections (13)
8and (14) are added to that section, to read:
9     320.08056  Specialty license plates.--
10     (4)  The following license plate annual use fees shall be
11collected for the appropriate specialty license plates:
12     (cc)  Choose Life license plate, $25 $20.
13     (qqq)  Autism license plate, $25.
14     (rrr)  Let's Go Surfing license plate, $25.
15     (sss)  Florida Horse Park license plate, $25.
16     (ttt)  St. Johns River license plate, $25.
17     (uuu)  Endless Summer license plate, $25.
18     (vvv)  Catch Me, Release Me license plate, $25.
19     (www)  Fraternal Order of Police license plate, $25.
20     (xxx)  Go Green Florida license plate, $25.
21     (yyy)  Florida Biodiversity Foundation license plate, $25.
22     (13)  Effective July 1, 2011, in addition to the
23requirements of subsections (10) and (11) and notwithstanding
24any specific authority provided in s. 320.08058, an organization
25or entity receiving annual use fee revenue from the sale of a
26specialty license plate may use no more than a total of 10
27percent of the revenues for administrative, marketing, and
28promotion costs, including annual audit and compliance affidavit
29costs.
30     (14)  Notwithstanding any other provision of this chapter,
31no annual use fee revenue derived from the sale of a specialty
32license plate, or the interest thereon, shall be expended on
33projects or programs outside this state.
34     Section 2.  Subsection (29), paragraph (b) of subsection
35(32), and subsection (35) of section 320.08058, Florida
36Statutes, are amended, and subsections (69) through (77) are
37added to that section, to read:
38     320.08058  Specialty license plates.--
39     (29)  CHOOSE LIFE LICENSE PLATES.--
40     (a)  The department shall develop a Choose Life license
41plate as provided in this section. The word "Florida" must
42appear at the bottom of the plate, and the words "Choose Life"
43must appear at the top of the plate.
44     (b)  The annual use fees shall be distributed quarterly to
45Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a
46list of annually to each county in the ratio that the annual use
47fees collected by each county bears to the total fees collected
48for the plates within the state.
49     (c)  Up to 10 percent of the fees may be used for
50administrative costs directly associated with the operations of
51Choose Life, Inc., and activities by Choose Life, Inc., to
52promote adoption and to market the license plate in this state.
53Choose Life, Inc., shall administer distribution of the
54remaining Each county shall distribute the funds to
55nongovernmental, not-for-profit agencies within the county,
56which agencies' services primarily consist of are limited to
57counseling and meeting the physical needs of pregnant women who
58are considering committed to placing their children for
59adoption.
60     1.  Funds may not be distributed to any agency that is
61involved or associated with abortion activities, including
62counseling for or referrals to abortion clinics, providing
63medical abortion-related procedures, or proabortion advertising,
64and funds may not be distributed to any agency that charges
65women for services received.
66     2.  Choose Life, Inc., may, from time to time, establish
67criteria pertaining to appropriate percentages of expenditures
68on items including, but not limited to, physical needs of women,
69physical needs of infants awaiting adoption, counseling,
70advertising, and training.
71     3.  Choose Life license plate funds generated in counties
72that do not have a qualified service provider shall be
73distributed by Choose Life, Inc., to qualified service providers
74in other counties.
75     4.  Funds shall not be removed from a county with active
76qualified service providers for distribution to service
77providers in other counties unless year-end unused fund balances
78exceed 20 percent of the county's annual Choose Life license
79plate revenues for 3 consecutive years. If year-end fund
80balances exceed 20 percent of a county's annual revenues for 3
81consecutive years, such balance may be distributed by Choose
82Life, Inc., to qualified service providers in other counties.
83     1.  Agencies that receive the funds must use at least 70
84percent of the funds to provide for the material needs of
85pregnant women who are committed to placing their children for
86adoption, including clothing, housing, medical care, food,
87utilities, and transportation. Such funds may also be expended
88on infants awaiting placement with adoptive parents.
89     2.  The remaining funds may be used for adoption,
90counseling, training, or advertising, but may not be used for
91administrative expenses, legal expenses, or capital
92expenditures.
93     5.3.  Each service provider agency that receives such funds
94must submit an annual attestation to Choose Life, Inc., which
95shall, upon request, make copies available to a state agency
96charged with auditing the county. Any unused funds that exceed
9710 percent of the funds received by an agency during its fiscal
98year must be returned to the county, which shall distribute them
99to other qualified agencies.
100     6.  Choose Life license plate use fees generated in this
101state may only be spent on activities within this state.
102     (d)1.  Within 90 days after the effective date of this
103paragraph, county commissions that have never distributed Choose
104Life funds shall forward such funds to Choose Life, Inc., for
105distribution.
106     2.  Within 180 days after the effective date of this
107paragraph, county commissions that have been distributing Choose
108Life funds shall forward fund balances to Choose Life, Inc., for
109distribution.
110     (32)  UNITED WE STAND LICENSE PLATES.--
111     (b)  The department shall retain all revenues from the sale
112of such plates until all startup costs for developing and
113issuing the plates have been recovered. Thereafter,
114notwithstanding s. 332.14, 100 percent of the annual use fee
115shall be distributed to the Department of Transportation SAFE
116Council for the development and implementation of programs to
117fund a grant program to enhance security at airports throughout
118the state, pursuant to s. 332.14. Up to 10 percent of the annual
119use fee revenue may be used for administration, promotion, and
120marketing of the plate, including annual audit and compliance
121affidavit costs.
122     (35)  FLORIDA GOLF LICENSE PLATES.--
123     (a)  The Department of Highway Safety and Motor Vehicles
124shall develop a Florida Golf license plate as provided in this
125section. The word "Florida" must appear at the bottom of the
126plate. The Dade Amateur Golf Association, following consultation
127with the PGA TOUR, the Florida Sports Foundation, the LPGA, and
128the PGA of America may submit a revised sample plate for
129consideration by the department.
130     (b)  The department shall distribute the Florida Golf
131license plate annual use fee to the Dade Amateur Golf
132Association, a s. 501(c)(3) organization Florida Sports
133Foundation, a direct-support organization of the Office of
134Tourism, Trade, and Economic Development. The license plate
135annual use fees are to be annually allocated as follows:
136     1.  Up to 10 5 percent of the proceeds from the annual use
137fees may be used by the Dade Amateur Golf Association Florida
138Sports Foundation for the administration of the Florida Junior
139Youth Golf Program.
140     2.  The Dade Amateur Golf Association shall receive the
141first $80,000 in proceeds from the annual use fees for the
142operation of youth golf programs in Miami-Dade County.
143Thereafter, 15 percent of the proceeds from the annual use fees
144shall be provided to the Dade Amateur Golf Association for the
145operation of youth golf programs in Miami-Dade County.
146     3.  The remaining proceeds from the annual use fees shall
147be available for grants to nonprofit organizations to operate
148youth golf programs and for marketing the Florida Golf license
149plates. All grant recipients, including the Dade Amateur Golf
150Association, shall be required to provide to the Dade Amateur
151Golf Association Florida Sports Foundation an annual program and
152financial report regarding the use of grant funds. Such reports
153shall be made available to the public.
154     (c)  The Dade Amateur Golf Association shall Florida Sports
155Foundation may establish a Florida Junior Golf Council Youth
156Golf Program. The Florida Junior Golf Council Youth Golf Program
157shall assist organizations for the benefit of youth, introduce
158young people to golf, instruct young people in golf, teach the
159values of golf, and stress life skills, fair play, courtesy, and
160self-discipline.
161     (d)  The Dade Amateur Golf Association Florida Sports
162Foundation shall establish a seven-member Florida Junior Golf
163Council committee to offer advice regarding the distribution of
164the annual use fees for grants to nonprofit organizations. The
165council advisory committee shall consist of one member from a
166group serving youth, one member from a group serving disabled
167youth, and five members at large.
168     (69)  AUTISM LICENSE PLATES.--
169     (a)  The department shall develop an Autism license plate
170as provided in this section. Autism license plates must bear the
171colors and design approved by the department. The word "Florida"
172must appear at the top of the plate, and the words "Support
173Autism Programs" must appear at the bottom of the plate.
174     (b)  The proceeds from the license plate annual use fee
175shall be distributed to Achievement and Rehabilitation Centers,
176Inc., to fund service programs for autism and related
177disabilities throughout the state and to operate and establish
178programs to support individuals with autism and related
179disabilities through direct services, evaluation, training, and
180awareness. Achievement and Rehabilitation Centers, Inc., shall
181establish an Autism Services Grant Council that shall provide
182grants from available Autism license plate proceeds to nonprofit
183organizations for direct services and programs for individuals
184with autism and related disabilities and their families.
185Consideration for participation in such services and programs
186shall be given to applicants who are children or adults with
187autism and related disabilities and their families and shall
188include those who are on the Agency for Persons with
189Disabilities waiting lists for services. Achievement and
190Rehabilitation Centers, Inc., shall also establish an Autism
191License Plate Fund. Moneys in the fund shall be used by the
192grant council as provided in this paragraph. All funds received
193under this subsection must be used in this state.
194     (c)  Achievement and Rehabilitation Centers, Inc., may
195retain all proceeds from the annual use fee up to $85,000 until
196all documented startup costs for developing and establishing the
197plate have been recovered. Thereafter, the proceeds from the
198annual use fee shall be used as follows:
199     1.  Up to 10 percent of the proceeds from the annual use
200fee may be used for the administration of the Autism License
201Plate Fund, the Autism Services Grant Council, and related
202matters.
203     2.  Funds may be used as necessary for annual audit or
204compliance affidavit costs.
205     3.  Thirty-five percent of the proceeds from the annual use
206fee shall be used to establish and operate programs to support
207individuals with autism and related disabilities and their
208families through direct services, evaluation, training, and
209awareness in the state.
210     4.  The Center for Autism and Related Disabilities at the
211University of Miami shall receive 15 percent of the proceeds
212from the annual use fee for distribution, as determined
213appropriate by the director of that center, to the seven
214regional autism centers created under s. 1004.55. The regional
215centers shall use the proceeds to support the services they
216provide.
217     5.  The remaining proceeds from the annual use fee shall be
218available to the Autism Services Grant Council for grants to
219nonprofit organizations to operate direct services programs for
220individuals with autism and related disabilities and their
221families and for marketing the Autism license plate. All grant
222recipients, including Achievement and Rehabilitation Centers,
223Inc., and the Center for Autism and Related Disabilities, shall
224be required to provide to the Autism Services Grant Council an
225annual program and financial report regarding the use of grant
226funds. Such reports shall be made available to the public.
227     (d)  Notwithstanding any provision of law to the contrary,
228the first $10,000 in proceeds generated from voluntary
229contributions to the Autism License Plate Fund authorized in ss.
230320.02 and 322.08 shall be retained by the department to offset
231the department's implementation costs.
232     (70)  LET'S GO SURFING LICENSE PLATES.--
233     (a)  The department shall develop a Let's Go Surfing
234license plate as provided in this section. Let's Go Surfing
235license plates must bear the colors and design approved by the
236department. The word "Florida" must appear at the top of the
237plate, and the words "Let's Go Surfing" must appear at the
238bottom of the plate.
239     (b)  The license plate annual use fees shall be distributed
240to East Coast Surfing Hall of Fame and Museum, Inc., to fund
241activities, programs, and projects to promote Florida's surfing-
242related tourism, preserve Florida's surfing history and
243heritage, preserve Florida's surf and shores, and honor
244lifeguards who patrol Florida's surf and shores to protect
245beachgoers, surfers, and others. East Coast Surfing Hall of Fame
246and Museum, Inc., may retain all revenue from the annual use
247fees until all startup costs for developing and establishing the
248plate have been recovered. Thereafter, up to 10 percent of the
249annual use fee revenue may be used for administration,
250promotion, and marketing of the plate, including annual audit
251and compliance affidavit costs.
252     (71)  FLORIDA HORSE PARK LICENSE PLATES.--
253     (a)  The department shall develop a Florida Horse Park
254license plate as provided in this section. Florida Horse Park
255license plates must bear the colors and design approved by the
256department. The word "Florida" must appear at the top of the
257plate, and the words "Discover Florida's Horses" must appear at
258the bottom of the plate.
259     (b)  The annual use fees shall be distributed to the
260Florida Agriculture Center and Horse Park Authority created by
261s. 570.952, which shall retain all proceeds until all startup
262costs for developing and establishing the plate have been
263recovered. Thereafter, the proceeds shall be used as follows:
264     1.  A maximum of 10 percent of the proceeds from the annual
265use fees may be used for the administration, promotion, and
266marketing of the Florida Horse Park license plate.
267     2.  The remaining proceeds shall be used by the authority
268to promote the Florida Agriculture Center and Horse Park located
269in Marion County; to support continued development of the park,
270including the construction of additional educational facilities,
271barns, and other structures; to provide improvements to the
272existing infrastructure at the park; and to provide for
273operational expenses of the Florida Agriculture Center and Horse
274Park.
275     (72)  ST. JOHNS RIVER LICENSE PLATES.--
276     (a)  The department shall develop a St. Johns River license
277plate as provided in this section. St. Johns River license
278plates must bear the colors and design approved by the
279department. The word "Florida" must appear at the top of the
280plate, and the words "St. Johns River" must appear at the bottom
281of the plate.
282     (b)  The requirements of s. 320.08053 must be met prior to
283the issuance of the plate. Thereafter, the license plate annual
284use fees shall be distributed to the St. Johns River Alliance,
285Inc., a s. 501(c)(3) nonprofit organization, which shall
286administer the fees as follows:
287     1.  The St. Johns River Alliance, Inc., shall retain the
288first $60,000 of the annual use fees as direct reimbursement for
289administrative costs, startup costs, and costs incurred in the
290development and approval process. Thereafter, up to 10 percent
291of the annual use fee revenue may be used for administrative
292costs directly associated with education programs, conservation,
293research, and grant administration of the organization and for
294promotion and marketing of the specialty license plate.
295     2.  At least 30 percent of the fees shall be available for
296competitive grants for targeted community-based or county-based
297research or projects for which state funding is limited or not
298currently available. The remaining 50 percent shall be directed
299toward community outreach and access programs. The competitive
300grants shall be administered and approved by the board of
301directors of the St. Johns River Alliance, Inc. A grant advisory
302committee shall be composed of six members chosen by the St.
303Johns River Alliance board members.
304     3.  Any remaining funds shall be distributed with the
305approval of and accountability to the board of directors of the
306St. Johns River Alliance, Inc., and shall be used to support
307activities contributing to education, outreach, and springs
308conservation.
309     (73)  ENDLESS SUMMER LICENSE PLATES.--
310     (a)  The department shall develop an Endless Summer license
311plate as provided in this section. Endless Summer license plates
312must bear the colors and design approved by the department. The
313word "Florida" must appear at the top of the plate, and the
314words "Endless Summer" must appear at the bottom of the plate.
315     (b)  The license plate annual use fees shall be distributed
316to Surfing's Evolution & Preservation Corporation to fund its
317activities, programs, and projects aimed at preserving the sport
318of surfing. Surfing's Evolution & Preservation Corporation may
319retain all revenue from the annual use fees until all startup
320costs for developing and establishing the plate have been
321recovered. Thereafter, up to 10 percent of the annual use fee
322revenue may be used for promotion and marketing of the specialty
323license plate and administrative costs directly associated with
324the corporation's programs and the specialty license plate.
325Surfing's Evolution & Preservation Corporation shall use the
326remaining funds as follows:
327     1.  To fund the proposed Surfing's Evolution & Preservation
328Experience project.
329     2.  To provide funds for the provision of lifeguards or the
330building of artificial reefs.
331     3.  To provide funds to organizations that house the
332history and artifacts of surfing or promote the sport through
333exhibits, lectures, and events.
334     4.  To support programs and events of other organizations
335that support beaches and oceans and promote education on beach
336safety, coastal pollution, and beach ecology.
337     (74)  CATCH ME, RELEASE ME LICENSE PLATES.--
338     (a)  The department shall develop a Catch Me, Release Me
339license plate as provided in this section. Catch Me, Release Me
340license plates must bear the colors and design approved by the
341department. The word "Florida" must appear at the top of the
342plate, and the words "Catch Me, Release Me" must appear at the
343bottom of the plate.
344     (b)  The license plate annual use fees shall be distributed
345to the Guy Harvey Ocean Foundation, Inc., to fund marine-related
346scientific research, including research of free-ranging pelagic
347marine species that inhabit, use, or migrate through Florida
348waters; conservation initiatives; and education and public
349outreach programs targeting school-aged children in the state.
350The Guy Harvey Ocean Foundation, Inc., may retain all revenue up
351to $60,000 from the annual use fees until all startup costs for
352developing and establishing the plate have been recovered.
353Thereafter, up to 10 percent of the annual use fee revenue may
354be used for administrative costs directly associated with the
355operations of the Guy Harvey Ocean Foundation, Inc., and up to
35610 percent may be used for promotion and marketing of the
357specialty license plate.
358     (75)  FRATERNAL ORDER OF POLICE LICENSE PLATES.--
359     (a)  The department shall develop a Fraternal Order of
360Police license plate as provided in this section. Fraternal
361Order of Police license plates must bear the colors and design
362approved by the department. The word "Florida" must appear at
363the top of the plate, and the words "Fraternal Order of Police"
364must appear at the bottom of the plate.
365     (b)  In order to purchase the Fraternal Order of Police
366license plate, a person must submit a certified letter from the
367Florida State Lodge of the Fraternal Order of Police showing
368that he or she qualifies for the use of the Fraternal Order of
369Police law enforcement emblem by being a member in good
370standing.
371     (c)  The license plate annual use fees shall be distributed
372to the Florida State Lodge Fraternal Order of Police Memorial
373Foundation to fund its activities, programs, and projects aimed
374at preserving, maintaining, and expanding the Florida Fraternal
375Order of Police Law Enforcement Memorial. The Florida State
376Lodge of the Fraternal Order of Police may retain all revenue
377from the annual use fees until all startup costs for developing
378and establishing the plate have been recovered. Thereafter, up
379to 10 percent of the annual use fee revenue may be used for
380promotion and marketing of the specialty license plate and
381administrative costs directly associated with memorial programs
382and the specialty license plate. The Florida State Lodge  
383Fraternal Order of Police Memorial Foundation shall use the
384remaining funds as follows:
385     1.  To fund the Florida State Fraternal Order of Police Law
386Enforcement Memorial projects.
387     2.  To provide funds for the expansion, maintenance, and
388support of the Florida State Lodge Fraternal Order of Police
389Memorial Foundation.
390     3.  To provide funds to organizations that help support the
391families of law enforcement officers who have died in the line
392of duty.
393     4.  To support programs and events that support the Florida
394Fraternal Order of Police Law Enforcement Memorial.
395     (76)  GO GREEN FLORIDA LICENSE PLATES.--
396     (a)  The department shall develop a Go Green Florida
397license plate as provided in this section. Go Green Florida
398license plates must bear the colors and design approved by the
399department. The word "Florida" must appear at the top of the
400plate, the words "Go Green" must appear on the bottom of the
401plate, and the "Go Green Florida" emblem or logo must appear on
402the plate.
403     (b)  The requirements of s. 320.08053 must be met prior to
404the issuance of the plate. The annual use fees shall be
405distributed to the Coalition for Renewable Energy Solutions,
406Inc. After reimbursement for documented costs expended to
407establish the plate, the proceeds of the annual use fees shall
408be used in the following manner:
409     1.  Up to 10 percent may be used by the Coalition for
410Renewable Energy Solutions, Inc., for administrative, promotion,
411and marketing costs.
412     2.  The remainder shall be used to fund the Solar Energy
413System Incentives Program pursuant to s. 377.806, as directed by
414the Florida Energy and Climate Commission. These funds may be
415remitted directly from the department to the Solar Energy System
416Incentives Program on a quarterly basis based on a calculation
417of fees collected.
418     (c)  The Coalition for Renewable Energy Solutions, Inc.,
419shall submit financial records and statements to the Office of
420the Auditor General for all expenditures related to the Go Green
421Florida program no later than 60 days after the end of each
422fiscal year.
423     (d)  The "Go Green Florida" emblem or logo may be
424authorized for use by the department in recognition of energy-
425efficient vehicle usage and practices. The display of the decal
426for energy-efficient practices may not be considered a
427substitute for a legal license tag.
428     (77)  FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.--
429     (a)  The department shall develop a Florida Biodiversity
430Foundation license plate as provided in this section. Florida
431Biodiversity Foundation license plates must bear the colors and
432design approved by the department. The word "Florida" must
433appear at the top of the plate, and the words "Save Wild
434Florida" must appear at the bottom of the plate.
435     (b)  The annual use fees shall be distributed to the
436Florida Biodiversity Foundation, Inc., which shall retain 50
437percent of the proceeds until the startup costs to develop and
438establish the plates have been recovered. Thereafter, the
439proceeds shall be used as follows:
440     1.  A maximum of 10 percent of the proceeds may be used to
441fund the administrative, promotion, and marketing costs of the
442license plate program and the foundation.
443     2.  The remaining fees shall be used by the foundation to
444fund research, education, and scientific study of the diversity
445of animals and plants and to aid in the preservation, study,
446conservation, and recovery of imperiled organisms.
447     Section 3.  Paragraphs (h) and (i) are added to subsection
448(15) of section 320.02, Florida Statutes, to read:
449     320.02  Registration required; application for
450registration; forms.--
451     (15)
452     (h)  The application form for motor vehicle registration
453and renewal of registration must include language permitting a
454voluntary contribution of $5 to the Autism License Plate Fund
455administered by Achievement and Rehabilitation Centers, Inc.
456Except as provided in s. 320.08058(69)(d), such contributions
457must be distributed by the department each month to the Autism
458License Plate Fund administered by Achievement and
459Rehabilitation Centers, Inc., to be used as provided in s.
460320.08058(69).
461     (i)  The application form for motor vehicle registration
462and renewal of registration must include language permitting a
463voluntary contribution of $1 to Ronald McDonald Houses of
464Florida. Such contributions must be distributed by the
465department each month to Ronald McDonald House Charities Tampa
466Bay, Inc., a not-for-profit organization.

468For the purpose of applying the service charge provided in s.
469215.20, contributions received under this subsection are not
470income of a revenue nature.
471     Section 4.  Section 320.0706, Florida Statutes, is amended
472to read:
473     320.0706  Display of license plates on trucks.--The owner
474of any commercial truck of gross vehicle weight of 26,001 pounds
475or more shall display the registration license plate on both the
476front and rear of the truck in conformance with all the
477requirements of s. 316.605 that do not conflict with this
478section. The owner of a dump truck may place the rear license
479plate on the gate no higher than 60 inches to allow for better
480visibility. However, the owner of a truck tractor shall be
481required to display the registration license plate only on the
482front of such vehicle. The owner of any wrecker issued a regular
483wrecker license plate shall display the license plate only on
484the front of the vehicle. The owner of any wrecker issued gross
485vehicle weight wrecker license plates shall display the license
486plates on both the front and rear of the vehicle in conformance
487with the requirements of s. 316.605 that do not conflict with
488this section. A violation of this section is a noncriminal
489traffic infraction, punishable as a moving violation as provided
490in chapter 318.
491     Section 5.  Subsection (6) of section 322.08, Florida
492Statutes, is amended to read:
493     322.08  Application for license.--
494     (6)  The application form for a driver's license or
495duplicate thereof shall include language permitting the
496following:
497     (a)  A voluntary contribution of $1 per applicant, which
498contribution shall be deposited into the Health Care Trust Fund
499for organ and tissue donor education and for maintaining the
500organ and tissue donor registry.
501     (b)  A voluntary contribution of $1 per applicant, which
502contribution shall be distributed to the Florida Council of the
503Blind.
504     (c)  A voluntary contribution of $2 per applicant, which
505shall be distributed to the Hearing Research Institute,
506Incorporated.
507     (d)  A voluntary contribution of $1 per applicant, which
508shall be distributed to the Juvenile Diabetes Foundation
509International.
510     (e)  A voluntary contribution of $1 per applicant, which
511shall be distributed to the Children's Hearing Help Fund.
512     (f)  A voluntary contribution of $1 per applicant, which
513shall be distributed to Family First, a nonprofit organization.
514     (g)  A voluntary contribution of $5 per applicant, which,
515except as provided in s. 320.08058(69)(d), shall be distributed
