A bill to be entitled
2An act relating to motor vehicles; amending s. 320.08056,
3F.S.; revising the annual use fee for the Choose Life
4license plate; establishing annual use fees for specified
5license plates; limiting the use of proceeds from the sale
6of specialty license plates; amending s. 320.08058, F.S.;
7revising authorized uses of proceeds received from the
8sale of the Choose Life license plate, United We Stand
9license plate, and Florida Golf license plate; creating an
10Autism license plate, a Let's Go Surfing license plate, a
11Florida Horse Park license plate, a St. Johns River
12license plate, an Endless Summer license plate, a Catch
13Me, Release Me license plate, a Fraternal Order of Police
14license plate, a Go Green Florida license plate, and a
15Florida Biodiversity Foundation license plate; providing
16for the distribution of use fees received from the sale of
17such plates; amending s. 320.02, F.S.; requiring the
18application form for motor vehicle registration and
19renewal of registration to include language permitting a
20voluntary contribution to the Autism License Plate Fund
21and Ronald McDonald Houses of Florida; providing for
22distribution of such contributions; amending s. 320.06,
23F.S.; revising the period after which a registration
24license plate must be replaced; revising the fees for such
25replacement; removing a requirement that license plates
26and validation stickers be treated with a retroreflective
27material; removing a requirement that the size of
28validation stickers be specified by the department;
29revising the purpose of a fee collected on each motor
30vehicle registration or motor vehicle renewal registration
31issued; amending s. 320.0706, F.S.; providing for the
32display of license plates on wreckers; providing
33penalties; amending s. 322.08, F.S.; requiring the
34application form for a driver's license or duplicate
35thereof to include language permitting a voluntary
36contribution to the Autism License Plate Fund; providing
37an effective date.

39Be It Enacted by the Legislature of the State of Florida:
40
41     Section 1.  Paragraph (cc) of subsection (4) of section
42320.08056, Florida Statutes, is amended, paragraphs (qqq)
43through (yyy) are added to that subsection, and subsections (13)
44and (14) are added to that section, to read:
45     320.08056  Specialty license plates.--
46     (4)  The following license plate annual use fees shall be
47collected for the appropriate specialty license plates:
48     (cc)  Choose Life license plate, $25 $20.
49     (qqq)  Autism license plate, $25.
50     (rrr)  Let's Go Surfing license plate, $25.
51     (sss)  Florida Horse Park license plate, $25.
52     (ttt)  St. Johns River license plate, $25.
53     (uuu)  Endless Summer license plate, $25.
54     (vvv)  Catch Me, Release Me license plate, $25.
55     (www)  Fraternal Order of Police license plate, $25.
56     (xxx)  Go Green Florida license plate, $25.
57     (yyy)  Florida Biodiversity Foundation license plate, $25.
58     (13)  Effective July 1, 2011, in addition to the
59requirements of subsections (10) and (11) and notwithstanding
60any specific authority provided in s. 320.08058, an organization
61or entity receiving annual use fee revenue from the sale of a
62specialty license plate may use no more than a total of 10
63percent of the revenues for administrative, marketing, and
64promotion costs, including annual audit and compliance affidavit
65costs.
66     (14)  Notwithstanding any other provision of this chapter,
67no annual use fee revenue derived from the sale of a specialty
68license plate, or the interest thereon, shall be expended on
69projects or programs outside this state.
70     Section 2.  Subsection (29), paragraph (b) of subsection
71(32), and subsection (35) of section 320.08058, Florida
72Statutes, are amended, and subsections (69) through (77) are
73added to that section, to read:
74     320.08058  Specialty license plates.--
75     (29)  CHOOSE LIFE LICENSE PLATES.--
76     (a)  The department shall develop a Choose Life license
77plate as provided in this section. The word "Florida" must
78appear at the bottom of the plate, and the words "Choose Life"
79must appear at the top of the plate.
80     (b)  The annual use fees shall be distributed quarterly to
81Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a
82list of annually to each county in the ratio that the annual use
83fees collected by each county bears to the total fees collected
84for the plates within the state.
85     (c)  Up to 10 percent of the fees may be used for
86administrative costs directly associated with the operations of
87Choose Life, Inc., and activities by Choose Life, Inc., to
88promote adoption and to market the license plate in this state.
89Choose Life, Inc., shall administer distribution of the
90remaining Each county shall distribute the funds to
91nongovernmental, not-for-profit agencies within the county,
92which agencies' services primarily consist of are limited to
93counseling and meeting the physical needs of pregnant women who
94are considering committed to placing their children for
95adoption.
96     1.  Funds may not be distributed to any agency that is
97involved or associated with abortion activities, including
98counseling for or referrals to abortion clinics, providing
99medical abortion-related procedures, or proabortion advertising,
100and funds may not be distributed to any agency that charges
101women for services received.
102     2.  Choose Life, Inc., may, from time to time, establish
103criteria pertaining to appropriate percentages of expenditures
104on items including, but not limited to, physical needs of women,
105physical needs of infants awaiting adoption, counseling,
106advertising, and training.
107     3.  Choose Life license plate funds generated in counties
108that do not have a qualified service provider shall be
109distributed by Choose Life, Inc., to qualified service providers
110in other counties.
111     4.  Funds shall not be removed from a county with active
112qualified service providers for distribution to service
113providers in other counties unless year-end unused fund balances
114exceed 20 percent of the county's annual Choose Life license
115plate revenues for 3 consecutive years. If year-end fund
116balances exceed 20 percent of a county's annual revenues for 3
117consecutive years, such balance may be distributed by Choose
118Life, Inc., to qualified service providers in other counties.
119     1.  Agencies that receive the funds must use at least 70
120percent of the funds to provide for the material needs of
121pregnant women who are committed to placing their children for
122adoption, including clothing, housing, medical care, food,
123utilities, and transportation. Such funds may also be expended
124on infants awaiting placement with adoptive parents.
125     2.  The remaining funds may be used for adoption,
126counseling, training, or advertising, but may not be used for
127administrative expenses, legal expenses, or capital
128expenditures.
129     5.3.  Each service provider agency that receives such funds
130must submit an annual attestation to Choose Life, Inc., which
131shall, upon request, make copies available to a state agency
132charged with auditing the county. Any unused funds that exceed
13310 percent of the funds received by an agency during its fiscal
134year must be returned to the county, which shall distribute them
135to other qualified agencies.
136     6.  Choose Life license plate use fees generated in this
137state may only be spent on activities within this state.
138     (d)1.  Within 90 days after the effective date of this
139paragraph, county commissions that have never distributed Choose
140Life funds shall forward such funds to Choose Life, Inc., for
141distribution.
142     2.  Within 180 days after the effective date of this
143paragraph, county commissions that have been distributing Choose
144Life funds shall forward fund balances to Choose Life, Inc., for
145distribution.
146     (32)  UNITED WE STAND LICENSE PLATES.--
147     (b)  The department shall retain all revenues from the sale
148of such plates until all startup costs for developing and
149issuing the plates have been recovered. Thereafter,
150notwithstanding s. 332.14, 100 percent of the annual use fee
151shall be distributed to the Department of Transportation SAFE
152Council for the development and implementation of programs to
153fund a grant program to enhance security at airports throughout
154the state, pursuant to s. 332.14. Up to 10 percent of the annual
155use fee revenue may be used for administration, promotion, and
156marketing of the plate, including annual audit and compliance
157affidavit costs.
158     (35)  FLORIDA GOLF LICENSE PLATES.--
159     (a)  The Department of Highway Safety and Motor Vehicles
160shall develop a Florida Golf license plate as provided in this
161section. The word "Florida" must appear at the bottom of the
162plate. The Dade Amateur Golf Association, following consultation
163with the PGA TOUR, the Florida Sports Foundation, the LPGA, and
164the PGA of America may submit a revised sample plate for
165consideration by the department.
166     (b)  The department shall distribute the Florida Golf
167license plate annual use fee to the Dade Amateur Golf
168Association, a s. 501(c)(3) organization Florida Sports
169Foundation, a direct-support organization of the Office of
170Tourism, Trade, and Economic Development. The license plate
171annual use fees are to be annually allocated as follows:
172     1.  Up to 10 5 percent of the proceeds from the annual use
173fees may be used by the Dade Amateur Golf Association Florida
174Sports Foundation for the administration of the Florida Junior
175Youth Golf Program.
176     2.  The Dade Amateur Golf Association shall receive the
177first $80,000 in proceeds from the annual use fees for the
178operation of youth golf programs in Miami-Dade County.
179Thereafter, 15 percent of the proceeds from the annual use fees
180shall be provided to the Dade Amateur Golf Association for the
181operation of youth golf programs in Miami-Dade County.
182     3.  The remaining proceeds from the annual use fees shall
183be available for grants to nonprofit organizations to operate
184youth golf programs and for marketing the Florida Golf license
185plates. All grant recipients, including the Dade Amateur Golf
186Association, shall be required to provide to the Dade Amateur
187Golf Association Florida Sports Foundation an annual program and
188financial report regarding the use of grant funds. Such reports
189shall be made available to the public.
190     (c)  The Dade Amateur Golf Association shall Florida Sports
191Foundation may establish a Florida Junior Golf Council Youth
192Golf Program. The Florida Junior Golf Council Youth Golf Program
193shall assist organizations for the benefit of youth, introduce
194young people to golf, instruct young people in golf, teach the
195values of golf, and stress life skills, fair play, courtesy, and
196self-discipline.
197     (d)  The Dade Amateur Golf Association Florida Sports
198Foundation shall establish a seven-member Florida Junior Golf
199Council committee to offer advice regarding the distribution of
200the annual use fees for grants to nonprofit organizations. The
201council advisory committee shall consist of one member from a
202group serving youth, one member from a group serving disabled
203youth, and five members at large.
204     (69)  AUTISM LICENSE PLATES.--
205     (a)  The department shall develop an Autism license plate
206as provided in this section. Autism license plates must bear the
207colors and design approved by the department. The word "Florida"
208must appear at the top of the plate, and the words "Support
209Autism Programs" must appear at the bottom of the plate.
210     (b)  The proceeds from the license plate annual use fee
211shall be distributed to Achievement and Rehabilitation Centers,
212Inc., to fund service programs for autism and related
213disabilities throughout the state and to operate and establish
214programs to support individuals with autism and related
215disabilities through direct services, evaluation, training, and
216awareness. Achievement and Rehabilitation Centers, Inc., shall
217establish an Autism Services Grant Council that shall provide
218grants from available Autism license plate proceeds to nonprofit
219organizations for direct services and programs for individuals
220with autism and related disabilities and their families.
221Consideration for participation in such services and programs
222shall be given to applicants who are children or adults with
223autism and related disabilities and their families and shall
224include those who are on the Agency for Persons with
225Disabilities waiting lists for services. Achievement and
226Rehabilitation Centers, Inc., shall also establish an Autism
227License Plate Fund. Moneys in the fund shall be used by the
228grant council as provided in this paragraph. All funds received
229under this subsection must be used in this state.
230     (c)  Achievement and Rehabilitation Centers, Inc., may
231retain all proceeds from the annual use fee up to $85,000 until
232all documented startup costs for developing and establishing the
233plate have been recovered. Thereafter, the proceeds from the
234annual use fee shall be used as follows:
235     1.  Up to 10 percent of the proceeds from the annual use
236fee may be used for the administration of the Autism License
237Plate Fund, the Autism Services Grant Council, and related
238matters.
239     2.  Funds may be used as necessary for annual audit or
240compliance affidavit costs.
241     3.  Thirty-five percent of the proceeds from the annual use
242fee shall be used to establish and operate programs to support
243individuals with autism and related disabilities and their
244families through direct services, evaluation, training, and
245awareness in the state.
246     4.  The Center for Autism and Related Disabilities at the
247University of Miami shall receive 15 percent of the proceeds
248from the annual use fee for distribution, as determined
249appropriate by the director of that center, to the seven
250regional autism centers created under s. 1004.55. The regional
251centers shall use the proceeds to support the services they
252provide.
253     5.  The remaining proceeds from the annual use fee shall be
254available to the Autism Services Grant Council for grants to
255nonprofit organizations to operate direct services programs for
256individuals with autism and related disabilities and their
257families and for marketing the Autism license plate. All grant
258recipients, including Achievement and Rehabilitation Centers,
259Inc., and the Center for Autism and Related Disabilities, shall
260be required to provide to the Autism Services Grant Council an
261annual program and financial report regarding the use of grant
262funds. Such reports shall be made available to the public.
263     (d)  Notwithstanding any provision of law to the contrary,
264the first $10,000 in proceeds generated from voluntary
265contributions to the Autism License Plate Fund authorized in ss.
266320.02 and 322.08 shall be retained by the department to offset
267the department's implementation costs.
268     (70)  LET'S GO SURFING LICENSE PLATES.--
269     (a)  The department shall develop a Let's Go Surfing
270license plate as provided in this section. Let's Go Surfing
271license plates must bear the colors and design approved by the
272department. The word "Florida" must appear at the top of the
273plate, and the words "Let's Go Surfing" must appear at the
274bottom of the plate.
275     (b)  The license plate annual use fees shall be distributed
276to East Coast Surfing Hall of Fame and Museum, Inc., to fund
277activities, programs, and projects to promote Florida's surfing-
278related tourism, preserve Florida's surfing history and
279heritage, preserve Florida's surf and shores, and honor
280lifeguards who patrol Florida's surf and shores to protect
281beachgoers, surfers, and others. East Coast Surfing Hall of Fame
282and Museum, Inc., may retain all revenue from the annual use
283fees until all startup costs for developing and establishing the
284plate have been recovered. Thereafter, up to 10 percent of the
285annual use fee revenue may be used for administration,
286promotion, and marketing of the plate, including annual audit
287and compliance affidavit costs.
288     (71)  FLORIDA HORSE PARK LICENSE PLATES.--
289     (a)  The department shall develop a Florida Horse Park
290license plate as provided in this section. Florida Horse Park
291license plates must bear the colors and design approved by the
292department. The word "Florida" must appear at the top of the
293plate, and the words "Discover Florida's Horses" must appear at
294the bottom of the plate.
295     (b)  The annual use fees shall be distributed to the
296Florida Agriculture Center and Horse Park Authority created by
297s. 570.952, which shall retain all proceeds until all startup
298costs for developing and establishing the plate have been
299recovered. Thereafter, the proceeds shall be used as follows:
300     1.  A maximum of 10 percent of the proceeds from the annual
301use fees may be used for the administration, promotion, and
302marketing of the Florida Horse Park license plate.
303     2.  The remaining proceeds shall be used by the authority
304to promote the Florida Agriculture Center and Horse Park located
305in Marion County; to support continued development of the park,
306including the construction of additional educational facilities,
307barns, and other structures; to provide improvements to the
308existing infrastructure at the park; and to provide for
309operational expenses of the Florida Agriculture Center and Horse
310Park.
311     (72)  ST. JOHNS RIVER LICENSE PLATES.--
312     (a)  The department shall develop a St. Johns River license
313plate as provided in this section. St. Johns River license
314plates must bear the colors and design approved by the
315department. The word "Florida" must appear at the top of the
316plate, and the words "St. Johns River" must appear at the bottom
317of the plate.
318     (b)  The requirements of s. 320.08053 must be met prior to
319the issuance of the plate. Thereafter, the license plate annual
320use fees shall be distributed to the St. Johns River Alliance,
321Inc., a s. 501(c)(3) nonprofit organization, which shall
322administer the fees as follows:
323     1.  The St. Johns River Alliance, Inc., shall retain the
324first $60,000 of the annual use fees as direct reimbursement for
325administrative costs, startup costs, and costs incurred in the
326development and approval process. Thereafter, up to 10 percent
327of the annual use fee revenue may be used for administrative
328costs directly associated with education programs, conservation,
329research, and grant administration of the organization and for
330promotion and marketing of the specialty license plate.
331     2.  At least 30 percent of the fees shall be available for
332competitive grants for targeted community-based or county-based
333research or projects for which state funding is limited or not
334currently available. The remaining 50 percent shall be directed
335toward community outreach and access programs. The competitive
336grants shall be administered and approved by the board of
337directors of the St. Johns River Alliance, Inc. A grant advisory
338committee shall be composed of six members chosen by the St.
339Johns River Alliance board members.
340     3.  Any remaining funds shall be distributed with the
341approval of and accountability to the board of directors of the
342St. Johns River Alliance, Inc., and shall be used to support
343activities contributing to education, outreach, and springs
344conservation.
345     (73)  ENDLESS SUMMER LICENSE PLATES.--
346     (a)  The department shall develop an Endless Summer license
347plate as provided in this section. Endless Summer license plates
348must bear the colors and design approved by the department. The
349word "Florida" must appear at the top of the plate, and the
350words "Endless Summer" must appear at the bottom of the plate.
351     (b)  The license plate annual use fees shall be distributed
352to Surfing's Evolution & Preservation Corporation to fund its
353activities, programs, and projects aimed at preserving the sport
354of surfing. Surfing's Evolution & Preservation Corporation may
355retain all revenue from the annual use fees until all startup
356costs for developing and establishing the plate have been
357recovered. Thereafter, up to 10 percent of the annual use fee
358revenue may be used for promotion and marketing of the specialty
359license plate and administrative costs directly associated with
360the corporation's programs and the specialty license plate.
361Surfing's Evolution & Preservation Corporation shall use the
362remaining funds as follows:
363     1.  To fund the proposed Surfing's Evolution & Preservation
364Experience project.
365     2.  To provide funds for the provision of lifeguards or the
366building of artificial reefs.
367     3.  To provide funds to organizations that house the
368history and artifacts of surfing or promote the sport through
369exhibits, lectures, and events.
370     4.  To support programs and events of other organizations
371that support beaches and oceans and promote education on beach
372safety, coastal pollution, and beach ecology.
373     (74)  CATCH ME, RELEASE ME LICENSE PLATES.--
374     (a)  The department shall develop a Catch Me, Release Me
375license plate as provided in this section. Catch Me, Release Me
376license plates must bear the colors and design approved by the
377department. The word "Florida" must appear at the top of the
378plate, and the words "Catch Me, Release Me" must appear at the
379bottom of the plate.
380     (b)  The license plate annual use fees shall be distributed
381to the Guy Harvey Ocean Foundation, Inc., to fund marine-related
382scientific research, including research of free-ranging pelagic
383marine species that inhabit, use, or migrate through Florida
384waters; conservation initiatives; and education and public
385outreach programs targeting school-aged children in the state.
386The Guy Harvey Ocean Foundation, Inc., may retain all revenue up
387to $60,000 from the annual use fees until all startup costs for
388developing and establishing the plate have been recovered.
389Thereafter, up to 10 percent of the annual use fee revenue may
390be used for administrative costs directly associated with the
391operations of the Guy Harvey Ocean Foundation, Inc., and up to
39210 percent may be used for promotion and marketing of the
393specialty license plate.
394     (75)  FRATERNAL ORDER OF POLICE LICENSE PLATES.--
395     (a)  The department shall develop a Fraternal Order of
396Police license plate as provided in this section. Fraternal
397Order of Police license plates must bear the colors and design
398approved by the department. The word "Florida" must appear at
399the top of the plate, and the words "Fraternal Order of Police"
400must appear at the bottom of the plate.
401     (b)  In order to purchase the Fraternal Order of Police
402license plate, a person must submit a certified letter from the
403Florida State Lodge of the Fraternal Order of Police showing
404that he or she qualifies for the use of the Fraternal Order of
405Police law enforcement emblem by being a member in good
406standing.
407     (c)  The license plate annual use fees shall be distributed
408to the Florida State Lodge Fraternal Order of Police Memorial
409Foundation to fund its activities, programs, and projects aimed
410at preserving, maintaining, and expanding the Florida Fraternal
411Order of Police Law Enforcement Memorial. The Florida State
412Lodge of the Fraternal Order of Police may retain all revenue
413from the annual use fees until all startup costs for developing
414and establishing the plate have been recovered. Thereafter, up
415to 10 percent of the annual use fee revenue may be used for
416promotion and marketing of the specialty license plate and
417administrative costs directly associated with memorial programs
418and the specialty license plate. The Florida State Lodge  
419Fraternal Order of Police Memorial Foundation shall use the
420remaining funds as follows:
421     1.  To fund the Florida State Fraternal Order of Police Law
422Enforcement Memorial projects.
423     2.  To provide funds for the expansion, maintenance, and
424support of the Florida State Lodge Fraternal Order of Police
425Memorial Foundation.
426     3.  To provide funds to organizations that help support the
427families of law enforcement officers who have died in the line
428of duty.
429     4.  To support programs and events that support the Florida
430Fraternal Order of Police Law Enforcement Memorial.
431     (76)  GO GREEN FLORIDA LICENSE PLATES.--
432     (a)  The department shall develop a Go Green Florida
433license plate as provided in this section. Go Green Florida
434license plates must bear the colors and design approved by the
435department. The word "Florida" must appear at the top of the
436plate, the words "Go Green" must appear on the bottom of the
437plate, and the "Go Green Florida" emblem or logo must appear on
438the plate.
439     (b)  The requirements of s. 320.08053 must be met prior to
440the issuance of the plate. The annual use fees shall be
441distributed to the Coalition for Renewable Energy Solutions,
442Inc. After reimbursement for documented costs expended to
443establish the plate, the proceeds of the annual use fees shall
444be used in the following manner:
445     1.  Up to 10 percent may be used by the Coalition for
446Renewable Energy Solutions, Inc., for administrative, promotion,
447and marketing costs.
448     2.  The remainder shall be used to fund the Solar Energy
449System Incentives Program pursuant to s. 377.806, as directed by
450the Florida Energy and Climate Commission. These funds may be
451remitted directly from the department to the Solar Energy System
452Incentives Program on a quarterly basis based on a calculation
453of fees collected.
454     (c)  The Coalition for Renewable Energy Solutions, Inc.,
455shall submit financial records and statements to the Office of
456the Auditor General for all expenditures related to the Go Green
457Florida program no later than 60 days after the end of each
458fiscal year.
459     (d)  The "Go Green Florida" emblem or logo may be
460authorized for use by the department in recognition of energy-
461efficient vehicle usage and practices. The display of the decal
462for energy-efficient practices may not be considered a
463substitute for a legal license tag.
464     (77)  FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.--
465     (a)  The department shall develop a Florida Biodiversity
466Foundation license plate as provided in this section. Florida
467Biodiversity Foundation license plates must bear the colors and
468design approved by the department. The word "Florida" must
469appear at the top of the plate, and the words "Save Wild
470Florida" must appear at the bottom of the plate.
471     (b)  The annual use fees shall be distributed to the
472Florida Biodiversity Foundation, Inc., which shall retain 50
473percent of the proceeds until the startup costs to develop and
474establish the plates have been recovered. Thereafter, the
475proceeds shall be used as follows:
476     1.  A maximum of 10 percent of the proceeds may be used to
477fund the administrative, promotion, and marketing costs of the
478license plate program and the foundation.
479     2.  The remaining fees shall be used by the foundation to
480fund research, education, and scientific study of the diversity
481of animals and plants and to aid in the preservation, study,
482conservation, and recovery of imperiled organisms.
483     Section 3.  Paragraphs (h) and (i) are added to subsection
484(15) of section 320.02, Florida Statutes, to read:
485     320.02  Registration required; application for
486registration; forms.--
487     (15)
488     (h)  The application form for motor vehicle registration
489and renewal of registration must include language permitting a
490voluntary contribution of $5 to the Autism License Plate Fund
491administered by Achievement and Rehabilitation Centers, Inc.
492Except as provided in s. 320.08058(69)(d), such contributions
493must be distributed by the department each month to the Autism
494License Plate Fund administered by Achievement and
495Rehabilitation Centers, Inc., to be used as provided in s.
496320.08058(69).
497     (i)  The application form for motor vehicle registration
498and renewal of registration must include language permitting a
499voluntary contribution of $1 to Ronald McDonald Houses of
500Florida. Such contributions must be distributed by the
501department each month to Ronald McDonald House Charities Tampa
502Bay, Inc., a not-for-profit organization.

504For the purpose of applying the service charge provided in s.
505215.20, contributions received under this subsection are not
506income of a revenue nature.
507     Section 4.  Paragraph (b) of subsection (1) and subsection
508(3) of section 320.06, Florida Statutes, are amended to read:
509     320.06  Registration certificates, license plates, and
510validation stickers generally.--
511     (1)
512     (b)  Registration license plates bearing a graphic symbol
513and the alphanumeric system of identification shall be issued
514for a 10-year 6-year period. At the end of that 10-year 6-year
515period, upon renewal, the plate shall be replaced. The
516department shall stagger the implementation of the 10-year 6-
517year license plate replacement cycle. The fee for such
518replacement is $20 $12, $2 of which shall be paid each year
519before the plate is replaced, to be credited towards the next
520$20 $12 replacement fee. The fees shall be deposited into the
521Highway Safety Operating Trust Fund. A credit or refund shall
522not be given for any prior years' payments of such prorated
523replacement fee if the plate is replaced or surrendered before
524the end of the 10-year 6-year period, except that a credit may
525be given when a registrant is required by the department to
526replace a license plate under s. 320.08056(8)(a). With each
527license plate, there shall be issued a validation sticker
528showing the owner's birth month, license plate number, and the
529year of expiration or the appropriate renewal period if the
530owner is not a natural person. The validation sticker shall be
531placed on the upper right corner of the license plate. Such
532license plate and validation sticker shall be issued based on
533the applicant's appropriate renewal period. The registration
534period is a period of 12 months, the extended registration
535period is a period of 24 months, and all expirations shall occur
536based on the applicant's appropriate registration period. A
537vehicle with an apportioned registration shall be issued an
538annual license plate and a cab card that denote the declared
539gross vehicle weight for each apportioned jurisdiction in which
540the vehicle is authorized to operate.
541     (3)(a)  Registration license plates shall be of metal
542specially treated with a retroreflective material, as specified
543by the department. The registration license plate is designed to
544increase nighttime visibility and legibility and shall be at
545least 6 inches wide and not less than 12 inches in length,
546unless a plate with reduced dimensions is deemed necessary by
547the department to accommodate motorcycles, mopeds, or similar
548smaller vehicles. Validation stickers shall be treated with a
549retroreflective material, shall be of such size as specified by
550the department, and shall adhere to the license plate. The
551registration license plate shall be imprinted with a combination
552of bold letters and numerals or numerals, not to exceed seven
553digits, to identify the registration license plate number. The
554license plate shall also be imprinted with the word "Florida" at
555the top and the name of the county in which it is sold, the
556state motto, or the words "Sunshine State" at the bottom.
557Apportioned license plates shall have the word "Apportioned" at
558the bottom and license plates issued for vehicles taxed under s.
559320.08(3)(d), (4)(m) or (n), (5)(b) or (c), or (14) shall have
560the word "Restricted" at the bottom. License plates issued for
561vehicles taxed under s. 320.08(12) must be imprinted with the
562word "Florida" at the top and the word "Dealer" at the bottom.
563Manufacturer license plates issued for vehicles taxed under s.
564320.08(12) must be imprinted with the word "Florida" at the top
565and the word "Manufacturer" at the bottom. License plates issued
566for vehicles taxed under s. 320.08(5)(d) or (e) must be
567imprinted with the word "Wrecker" at the bottom. Any county may,
568upon majority vote of the county commission, elect to have the
569county name removed from the license plates sold in that county.
570The state motto or the words "Sunshine State" shall be printed
571in lieu thereof. A license plate issued for a vehicle taxed
572under s. 320.08(6) may not be assigned a registration license
573number, or be issued with any other distinctive character or
574designation, which that distinguishes the motor vehicle as a
575for-hire motor vehicle.
576     (b)  An additional fee of 50 cents shall be collected and
577deposited into the Highway Safety Operating Trust Fund on each
578motor vehicle registration or motor vehicle renewal registration
579issued in this state in order that material costs are paid for
580all license plates and validation stickers be fully treated with
581retroreflective material.
582     Section 5.  Section 320.0706, Florida Statutes, is amended
583to read:
584     320.0706  Display of license plates on trucks.--The owner
585of any commercial truck of gross vehicle weight of 26,001 pounds
586or more shall display the registration license plate on both the
587front and rear of the truck in conformance with all the
588requirements of s. 316.605 that do not conflict with this
589section. The owner of a dump truck may place the rear license
590plate on the gate no higher than 60 inches to allow for better
591visibility. However, the owner of a truck tractor shall be
592required to display the registration license plate only on the
593front of such vehicle. The owner of any wrecker issued a regular
594wrecker license plate shall display the license plate only on
595the front of the vehicle. The owner of any wrecker issued gross
596vehicle weight wrecker license plates shall display the license
597plates on both the front and rear of the vehicle in conformance
598with the requirements of s. 316.605 that do not conflict with
599this section. A violation of this section is a noncriminal
600traffic infraction, punishable as a moving violation as provided
601in chapter 318.
602     Section 6.  Subsection (6) of section 322.08, Florida
603Statutes, is amended to read:
604     322.08  Application for license.--
605     (6)  The application form for a driver's license or
606duplicate thereof shall include language permitting the
607following:
608     (a)  A voluntary contribution of $1 per applicant, which
609contribution shall be deposited into the Health Care Trust Fund
610for organ and tissue donor education and for maintaining the
611organ and tissue donor registry.
612     (b)  A voluntary contribution of $1 per applicant, which
613contribution shall be distributed to the Florida Council of the
614Blind.
615     (c)  A voluntary contribution of $2 per applicant, which
616shall be distributed to the Hearing Research Institute,
617Incorporated.
618     (d)  A voluntary contribution of $1 per applicant, which
619shall be distributed to the Juvenile Diabetes Foundation
620International.
621     (e)  A voluntary contribution of $1 per applicant, which
622shall be distributed to the Children's Hearing Help Fund.
623     (f)  A voluntary contribution of $1 per applicant, which
624shall be distributed to Family First, a nonprofit organization.
625     (g)  A voluntary contribution of $5 per applicant, which,
626except as provided in s. 320.08058(69)(d), shall be distributed
627to the Autism License Plate Fund administered by Achievement and
628Rehabilitation Centers, Inc., to be used as provided in s.
629320.08058(69).

631A statement providing an explanation of the purpose of the trust
632funds shall also be included. For the purpose of applying the
633service charge provided in s. 215.20, contributions received
634under paragraphs (b), (c), (d), (e), and (f), and (g) and under
635s. 322.18(9)(a) are not income of a revenue nature.
636     Section 7.  This act shall take effect July 1, 2009.
