A bill to be entitled
2An act relating to motor vehicles; amending s. 320.08056,
3F.S.; revising the annual use fee for the Choose Life
4license plate; establishing annual use fees for specified
5license plates; limiting the use of proceeds from the sale
6of specialty license plates; amending s. 320.08058, F.S.;
7revising authorized uses of proceeds received from the
8sale of the Choose Life license plate, United We Stand
9license plate, and Florida Golf license plate; creating an
10Autism license plate, a Let's Go Surfing license plate, a
11Florida Horse Park license plate, a St. Johns River
12license plate, an Endless Summer license plate, a Catch
13Me, Release Me license plate, a Fraternal Order of Police
14license plate, a Go Green Florida license plate, and a
15Florida Biodiversity Foundation license plate; providing
16for the distribution of use fees received from the sale of
17such plates; amending s. 320.02, F.S.; requiring the
18application form for motor vehicle registration and
19renewal of registration to include language permitting a
20voluntary contribution to the Autism License Plate Fund
21and Ronald McDonald Houses of Florida; providing for
22distribution of such contributions; amending s. 320.0706,
23F.S.; providing for the display of license plates on
24wreckers; providing penalties; amending s. 322.08, F.S.;
25requiring the application form for a driver's license or
26duplicate thereof to include language permitting a
27voluntary contribution to the Autism License Plate Fund;
28amending ss. 320.08056 and 320.08058, F.S.; creating a
29Hispanics Settled Florida in 1565 license plate;
30establishing an annual use fee for the plate; providing
31for the distribution of use fees received from the sale of
32such plates; providing an effective date.

34Be It Enacted by the Legislature of the State of Florida:
35
36     Section 1.  Paragraph (cc) of subsection (4) of section
37320.08056, Florida Statutes, is amended, paragraphs (qqq)
38through (yyy) are added to that subsection, and subsections (13)
39and (14) are added to that section, to read:
40     320.08056  Specialty license plates.--
41     (4)  The following license plate annual use fees shall be
42collected for the appropriate specialty license plates:
43     (cc)  Choose Life license plate, $25 $20.
44     (qqq)  Autism license plate, $25.
45     (rrr)  Let's Go Surfing license plate, $25.
46     (sss)  Florida Horse Park license plate, $25.
47     (ttt)  St. Johns River license plate, $25.
48     (uuu)  Endless Summer license plate, $25.
49     (vvv)  Catch Me, Release Me license plate, $25.
50     (www)  Fraternal Order of Police license plate, $25.
51     (xxx)  Go Green Florida license plate, $25.
52     (yyy)  Florida Biodiversity Foundation license plate, $25.
53     (13)  Effective July 1, 2011, in addition to the
54requirements of subsections (10) and (11) and notwithstanding
55any specific authority provided in s. 320.08058, an organization
56or entity receiving annual use fee revenue from the sale of a
57specialty license plate may use no more than a total of 20
58percent of the revenues for administrative, marketing, and
59promotion costs, including annual audit and compliance affidavit
60costs.
61     (14)  Notwithstanding any other provision of this chapter,
62no annual use fee revenue derived from the sale of a specialty
63license plate, or the interest thereon, shall be expended on
64projects or programs outside this state.
65     Section 2.  Subsection (29), paragraph (b) of subsection
66(32), and subsection (35) of section 320.08058, Florida
67Statutes, are amended, and subsections (69) through (77) are
68added to that section, to read:
69     320.08058  Specialty license plates.--
70     (29)  CHOOSE LIFE LICENSE PLATES.--
71     (a)  The department shall develop a Choose Life license
72plate as provided in this section. The word "Florida" must
73appear at the bottom of the plate, and the words "Choose Life"
74must appear at the top of the plate.
75     (b)  The annual use fees shall be distributed quarterly to
76Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a
77list of annually to each county in the ratio that the annual use
78fees collected by each county bears to the total fees collected
79for the plates within the state.
80     (c)  Up to 10 percent of the fees may be used for
81administrative costs directly associated with the operations of
82Choose Life, Inc., and activities by Choose Life, Inc., to
83promote adoption and to market the license plate in this state.
84Choose Life, Inc., shall administer distribution of the
85remaining Each county shall distribute the funds to
86nongovernmental, not-for-profit agencies within the county,
87which agencies' services primarily consist of are limited to
88counseling and meeting the physical needs of pregnant women who
89are considering committed to placing their children for
90adoption.
91     1.  Funds may not be distributed to any agency that is
92involved or associated with abortion activities, including
93counseling for or referrals to abortion clinics, providing
94medical abortion-related procedures, or proabortion advertising,
95and funds may not be distributed to any agency that charges
96women for services received.
97     2.  Choose Life, Inc., may, from time to time, establish
98criteria pertaining to appropriate percentages of expenditures
99on items including, but not limited to, physical needs of women,
100physical needs of infants awaiting adoption, counseling,
101advertising, and training.
102     3.  Choose Life license plate funds generated in counties
103that do not have a qualified service provider shall be
104distributed by Choose Life, Inc., to qualified service providers
105in other counties.
106     4.  Funds shall not be removed from a county with active
107qualified service providers for distribution to service
108providers in other counties unless year-end unused fund balances
109exceed 20 percent of the county's annual Choose Life license
110plate revenues for 3 consecutive years. If year-end fund
111balances exceed 20 percent of a county's annual revenues for 3
112consecutive years, such balance may be distributed by Choose
113Life, Inc., to qualified service providers in other counties.
114     1.  Agencies that receive the funds must use at least 70
115percent of the funds to provide for the material needs of
116pregnant women who are committed to placing their children for
117adoption, including clothing, housing, medical care, food,
118utilities, and transportation. Such funds may also be expended
119on infants awaiting placement with adoptive parents.
120     2.  The remaining funds may be used for adoption,
121counseling, training, or advertising, but may not be used for
122administrative expenses, legal expenses, or capital
123expenditures.
124     5.3.  Each service provider agency that receives such funds
125must submit an annual attestation to Choose Life, Inc., which
126shall, upon request, make copies available to a state agency
127charged with auditing the county. Any unused funds that exceed
12810 percent of the funds received by an agency during its fiscal
129year must be returned to the county, which shall distribute them
130to other qualified agencies.
131     6.  Choose Life license plate use fees generated in this
132state may only be spent on activities within this state.
133     (d)1.  Within 90 days after the effective date of this
134paragraph, county commissions that have never distributed Choose
135Life funds shall forward such funds to Choose Life, Inc., for
136distribution.
137     2.  Within 180 days after the effective date of this
138paragraph, county commissions that have been distributing Choose
139Life funds shall forward fund balances to Choose Life, Inc., for
140distribution.
141     (32)  UNITED WE STAND LICENSE PLATES.--
142     (b)  The department shall retain all revenues from the sale
143of such plates until all startup costs for developing and
144issuing the plates have been recovered. Thereafter,
145notwithstanding s. 332.14, 100 percent of the annual use fee
146shall be distributed to the Department of Transportation SAFE
147Council for the development and implementation of programs to
148fund a grant program to enhance security at airports throughout
149the state, pursuant to s. 332.14. Up to 10 percent of the annual
150use fee revenue may be used for administration, promotion, and
151marketing of the plate, including annual audit and compliance
152affidavit costs.
153     (35)  FLORIDA GOLF LICENSE PLATES.--
154     (a)  The Department of Highway Safety and Motor Vehicles
155shall develop a Florida Golf license plate as provided in this
156section. The word "Florida" must appear at the bottom of the
157plate. The Dade Amateur Golf Association, following consultation
158with the PGA TOUR, the Florida Sports Foundation, the LPGA, and
159the PGA of America may submit a revised sample plate for
160consideration by the department.
161     (b)  The department shall distribute the Florida Golf
162license plate annual use fee to the Dade Amateur Golf
163Association, a s. 501(c)(3) organization Florida Sports
164Foundation, a direct-support organization of the Office of
165Tourism, Trade, and Economic Development. The license plate
166annual use fees are to be annually allocated as follows:
167     1.  Up to 10 5 percent of the proceeds from the annual use
168fees may be used by the Dade Amateur Golf Association Florida
169Sports Foundation for the administration of the Florida Junior
170Youth Golf Program.
171     2.  The Dade Amateur Golf Association shall receive the
172first $80,000 in proceeds from the annual use fees for the
173operation of youth golf programs in Miami-Dade County.
174Thereafter, 15 percent of the proceeds from the annual use fees
175shall be provided to the Dade Amateur Golf Association for the
176operation of youth golf programs in Miami-Dade County.
177     3.  The remaining proceeds from the annual use fees shall
178be available for grants to nonprofit organizations to operate
179youth golf programs and for marketing the Florida Golf license
180plates. All grant recipients, including the Dade Amateur Golf
181Association, shall be required to provide to the Dade Amateur
182Golf Association Florida Sports Foundation an annual program and
183financial report regarding the use of grant funds. Such reports
184shall be made available to the public.
185     (c)  The Dade Amateur Golf Association shall Florida Sports
186Foundation may establish a Florida Junior Golf Council Youth
187Golf Program. The Florida Junior Golf Council Youth Golf Program
188shall assist organizations for the benefit of youth, introduce
189young people to golf, instruct young people in golf, teach the
190values of golf, and stress life skills, fair play, courtesy, and
191self-discipline.
192     (d)  The Dade Amateur Golf Association Florida Sports
193Foundation shall establish a seven-member Florida Junior Golf
194Council committee to offer advice regarding the distribution of
195the annual use fees for grants to nonprofit organizations. The
196council advisory committee shall consist of one member from a
197group serving youth, one member from a group serving disabled
198youth, and five members at large.
199     (69)  AUTISM LICENSE PLATES.--
200     (a)  The department shall develop an Autism license plate
201as provided in this section. Autism license plates must bear the
202colors and design approved by the department. The word "Florida"
203must appear at the top of the plate, and the words "Support
204Autism Programs" must appear at the bottom of the plate.
205     (b)  The proceeds from the license plate annual use fee
206shall be distributed to Achievement and Rehabilitation Centers,
207Inc., to fund service programs for autism and related
208disabilities throughout the state and to operate and establish
209programs to support individuals with autism and related
210disabilities through direct services, evaluation, training, and
211awareness. Achievement and Rehabilitation Centers, Inc., shall
212establish an Autism Services Grant Council that shall provide
213grants from available Autism license plate proceeds to nonprofit
214organizations for direct services and programs for individuals
215with autism and related disabilities and their families.
216Consideration for participation in such services and programs
217shall be given to applicants who are children or adults with
218autism and related disabilities and their families and shall
219include those who are on the Agency for Persons with
220Disabilities waiting lists for services. Achievement and
221Rehabilitation Centers, Inc., shall also establish an Autism
222License Plate Fund. Moneys in the fund shall be used by the
223grant council as provided in this paragraph. All funds received
224under this subsection must be used in this state.
225     (c)  Achievement and Rehabilitation Centers, Inc., may
226retain all proceeds from the annual use fee up to $85,000 until
227all documented startup costs for developing and establishing the
228plate have been recovered. Thereafter, the proceeds from the
229annual use fee shall be used as follows:
230     1.  Up to 10 percent of the proceeds from the annual use
231fee may be used for the cost of administration, marketing, and
232promotion of the Autism License Plate Fund, the Autism Services
233Grant Council, and related matters, including annual audit and
234compliance affidavit costs.
235     2.  Funds may be used as necessary for annual audit or
236compliance affidavit costs.
237     3.  Thirty-five percent of the proceeds from the annual use
238fee shall be used to establish and operate programs to support
239individuals with autism and related disabilities and their
240families through direct services, evaluation, training, and
241awareness in the state.
242     4.  The Center for Autism and Related Disabilities at the
243University of Miami shall receive 15 percent of the proceeds
244from the annual use fee for distribution, as determined
245appropriate by the director of that center, to the seven
246regional autism centers created under s. 1004.55. The regional
247centers shall use the proceeds to support the services they
248provide.
249     5.  The remaining proceeds from the annual use fee shall be
250available to the Autism Services Grant Council for grants to
251nonprofit organizations to operate direct services programs for
252individuals with autism and related disabilities and their
253families. All grant recipients, including Achievement and
254Rehabilitation Centers, Inc., and the Center for Autism and
255Related Disabilities, shall be required to provide to the Autism
256Services Grant Council an annual program and financial report
257regarding the use of grant funds. Such reports shall be made
258available to the public.
259     (d)  Notwithstanding any provision of law to the contrary,
260the first $10,000 in proceeds generated from voluntary
261contributions to the Autism License Plate Fund authorized in ss.
262320.02 and 322.08 shall be retained by the department to offset
263the department's implementation costs.
264     (70)  LET'S GO SURFING LICENSE PLATES.--
265     (a)  The department shall develop a Let's Go Surfing
266license plate as provided in this section. Let's Go Surfing
267license plates must bear the colors and design approved by the
268department. The word "Florida" must appear at the top of the
269plate, and the words "Let's Go Surfing" must appear at the
270bottom of the plate.
271     (b)  The license plate annual use fees shall be distributed
272to East Coast Surfing Hall of Fame and Museum, Inc., to fund
273activities, programs, and projects to promote Florida's surfing-
274related tourism, preserve Florida's surfing history and
275heritage, preserve Florida's surf and shores, and honor
276lifeguards who patrol Florida's surf and shores to protect
277beachgoers, surfers, and others. East Coast Surfing Hall of Fame
278and Museum, Inc., may retain all revenue from the annual use
279fees until all startup costs for developing and establishing the
280plate have been recovered. Thereafter, up to 10 percent of the
281annual use fee revenue may be used for administration,
282promotion, and marketing of the plate, including annual audit
283and compliance affidavit costs.
284     (71)  FLORIDA HORSE PARK LICENSE PLATES.--
285     (a)  The department shall develop a Florida Horse Park
286license plate as provided in this section. Florida Horse Park
287license plates must bear the colors and design approved by the
288department. The word "Florida" must appear at the top of the
289plate, and the words "Discover Florida's Horses" must appear at
290the bottom of the plate.
291     (b)  The annual use fees shall be distributed to the
292Florida Agriculture Center and Horse Park Authority created by
293s. 570.952, which shall retain all proceeds until all startup
294costs for developing and establishing the plate have been
295recovered. Thereafter, the proceeds shall be used as follows:
296     1.  A maximum of 10 percent of the proceeds from the annual
297use fees may be used for the administration, promotion, and
298marketing of the Florida Horse Park license plate.
299     2.  The remaining proceeds shall be used by the authority
300to promote the Florida Agriculture Center and Horse Park located
301in Marion County; to support continued development of the park,
302including the construction of additional educational facilities,
303barns, and other structures; to provide improvements to the
304existing infrastructure at the park; and to provide for
305operational expenses of the Florida Agriculture Center and Horse
306Park.
307     (72)  ST. JOHNS RIVER LICENSE PLATES.--
308     (a)  The department shall develop a St. Johns River license
309plate as provided in this section. St. Johns River license
310plates must bear the colors and design approved by the
311department. The word "Florida" must appear at the top of the
312plate, and the words "St. Johns River" must appear at the bottom
313of the plate.
314     (b)  The requirements of s. 320.08053 must be met prior to
315the issuance of the plate. Thereafter, the license plate annual
316use fees shall be distributed to the St. Johns River Alliance,
317Inc., a s. 501(c)(3) nonprofit organization, which shall
318administer the fees as follows:
319     1.  The St. Johns River Alliance, Inc., shall retain the
320first $60,000 of the annual use fees as direct reimbursement for
321administrative costs, startup costs, and costs incurred in the
322development and approval process. Thereafter, up to 10 percent
323of the annual use fee revenue may be used for administrative
324costs directly associated with education programs, conservation,
325research, and grant administration of the organization and for
326promotion and marketing of the specialty license plate.
327     2.  At least 30 percent of the fees shall be available for
328competitive grants for targeted community-based or county-based
329research or projects for which state funding is limited or not
330currently available. The remaining 50 percent shall be directed
331toward community outreach and access programs. The competitive
332grants shall be administered and approved by the board of
333directors of the St. Johns River Alliance, Inc. A grant advisory
334committee shall be composed of six members chosen by the St.
335Johns River Alliance board members.
336     3.  Any remaining funds shall be distributed with the
337approval of and accountability to the board of directors of the
338St. Johns River Alliance, Inc., and shall be used to support
339activities contributing to education, outreach, and springs
340conservation.
341     (73)  ENDLESS SUMMER LICENSE PLATES.--
342     (a)  The department shall develop an Endless Summer license
343plate as provided in this section. Endless Summer license plates
344must bear the colors and design approved by the department. The
345word "Florida" must appear at the top of the plate, and the
346words "Endless Summer" must appear at the bottom of the plate.
347     (b)  The license plate annual use fees shall be distributed
348to Surfing's Evolution & Preservation Corporation to fund its
349activities, programs, and projects aimed at preserving the sport
350of surfing. Surfing's Evolution & Preservation Corporation may
351retain all revenue from the annual use fees until all startup
352costs for developing and establishing the plate have been
353recovered. Thereafter, up to 10 percent of the annual use fee
354revenue may be used for promotion and marketing of the specialty
355license plate and administrative costs directly associated with
356the corporation's programs and the specialty license plate.
357Surfing's Evolution & Preservation Corporation shall use the
358remaining funds as follows:
359     1.  To fund the proposed Surfing's Evolution & Preservation
360Experience project.
361     2.  To provide funds for the provision of lifeguards or the
362building of artificial reefs.
363     3.  To provide funds to organizations that house the
364history and artifacts of surfing or promote the sport through
365exhibits, lectures, and events.
366     4.  To support programs and events of other organizations
367that support beaches and oceans and promote education on beach
368safety, coastal pollution, and beach ecology.
369     (74)  CATCH ME, RELEASE ME LICENSE PLATES.--
370     (a)  The department shall develop a Catch Me, Release Me
371license plate as provided in this section. Catch Me, Release Me
372license plates must bear the colors and design approved by the
373department. The word "Florida" must appear at the top of the
374plate, and the words "Catch Me, Release Me" must appear at the
375bottom of the plate.
376     (b)  The license plate annual use fees shall be distributed
377to the Guy Harvey Ocean Foundation, Inc., to fund marine-related
378scientific research, including research of free-ranging pelagic
379marine species that inhabit, use, or migrate through Florida
380waters; conservation initiatives; and education and public
381outreach programs targeting school-aged children in the state.
382The Guy Harvey Ocean Foundation, Inc., may retain all revenue up
383to $60,000 from the annual use fees until all startup costs for
384developing and establishing the plate have been recovered.
385Thereafter, up to 10 percent of the annual use fee revenue may
386be used for administrative costs directly associated with the
387operations of the Guy Harvey Ocean Foundation, Inc., and up to
38810 percent may be used for promotion and marketing of the
389specialty license plate.
390     (75)  FRATERNAL ORDER OF POLICE LICENSE PLATES.--
391     (a)  The department shall develop a Fraternal Order of
392Police license plate as provided in this section. Fraternal
393Order of Police license plates must bear the colors and design
394approved by the department. The word "Florida" must appear at
395the top of the plate, and the words "Fraternal Order of Police"
396must appear at the bottom of the plate.
397     (b)  In order to purchase the Fraternal Order of Police
398license plate, a person must submit a certified letter from the
399Florida State Lodge of the Fraternal Order of Police showing
400that he or she qualifies for the use of the Fraternal Order of
401Police law enforcement emblem by being a member in good
402standing.
403     (c)  The license plate annual use fees shall be distributed
404to the Florida State Lodge Fraternal Order of Police Memorial
405Foundation to fund its activities, programs, and projects aimed
406at preserving, maintaining, and expanding the Florida Fraternal
407Order of Police Law Enforcement Memorial. The Florida State
408Lodge of the Fraternal Order of Police may retain all revenue
409from the annual use fees until all startup costs for developing
410and establishing the plate have been recovered. Thereafter, up
411to 10 percent of the annual use fee revenue may be used for
412promotion and marketing of the specialty license plate and
413administrative costs directly associated with memorial programs
414and the specialty license plate. The Florida State Lodge  
415Fraternal Order of Police Memorial Foundation shall use the
416remaining funds as follows:
417     1.  To fund the Florida State Fraternal Order of Police Law
418Enforcement Memorial projects.
419     2.  To provide funds for the expansion, maintenance, and
420support of the Florida State Lodge Fraternal Order of Police
421Memorial Foundation.
422     3.  To provide funds to organizations that help support the
423families of law enforcement officers who have died in the line
424of duty.
425     4.  To support programs and events that support the Florida
426Fraternal Order of Police Law Enforcement Memorial.
427     (76)  GO GREEN FLORIDA LICENSE PLATES.--
428     (a)  The department shall develop a Go Green Florida
429license plate as provided in this section. Go Green Florida
430license plates must bear the colors and design approved by the
431department. The word "Florida" must appear at the top of the
432plate, the words "Go Green" must appear on the bottom of the
433plate, and the "Go Green Florida" emblem or logo must appear on
434the plate.
435     (b)  The requirements of s. 320.08053 must be met prior to
436the issuance of the plate. The annual use fees shall be
437distributed to the Coalition for Renewable Energy Solutions,
438Inc. After reimbursement for documented costs expended to
439establish the plate, the proceeds of the annual use fees shall
440be used in the following manner:
441     1.  Up to 10 percent may be used by the Coalition for
442Renewable Energy Solutions, Inc., for administrative, promotion,
443and marketing costs.
444     2.  The remainder shall be used to fund the Renewable
445Energy and Energy-Efficient Technologies Grants Program pursuant
446to s. 377.804, the Solar Energy System Incentives Program
447pursuant to s. 377.806, under the Florida Energy and Climate
448Commission, or other educational programs dedicated to providing
449effective alternative energy practices.
450     (c)  The coalition shall comply with the financial audit
451requirements of s. 320.08062.
452     (d)  The "Go Green Florida" emblem or logo may be
453authorized for use by the department in recognition of energy-
454efficient vehicle usage and practices. The display of the decal
455for energy-efficient practices may not be considered a
456substitute for a legal license tag.
457     (77)  FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.--
458     (a)  The department shall develop a Florida Biodiversity
459Foundation license plate as provided in this section. Florida
460Biodiversity Foundation license plates must bear the colors and
461design approved by the department. The word "Florida" must
462appear at the top of the plate, and the words "Save Wild
463Florida" must appear at the bottom of the plate.
464     (b)  The annual use fees shall be distributed to the
465Florida Biodiversity Foundation, Inc., which shall retain 50
466percent of the proceeds until the startup costs to develop and
467establish the plates have been recovered. Thereafter, the
468proceeds shall be used as follows:
469     1.  A maximum of 10 percent of the proceeds may be used to
470fund the administrative, promotion, and marketing costs of the
471license plate program and the foundation.
472     2.  The remaining fees shall be used by the foundation to
473fund research, education, and scientific study of the diversity
474of animals and plants and to aid in the preservation, study,
475conservation, and recovery of imperiled organisms.
476     Section 3.  Paragraphs (h) and (i) are added to subsection
477(15) of section 320.02, Florida Statutes, to read:
478     320.02  Registration required; application for
479registration; forms.--
480     (15)
481     (h)  The application form for motor vehicle registration
482and renewal of registration must include language permitting a
483voluntary contribution of $5 to the Autism License Plate Fund
484administered by Achievement and Rehabilitation Centers, Inc.
485Except as provided in s. 320.08058(69)(d), such contributions
486must be distributed by the department each month to the Autism
487License Plate Fund administered by Achievement and
488Rehabilitation Centers, Inc., to be used as provided in s.
489320.08058(69).
490     (i)  The application form for motor vehicle registration
491and renewal of registration must include language permitting a
492voluntary contribution of $1 to Ronald McDonald Houses of
493Florida. Such contributions must be distributed by the
494department each month to Ronald McDonald House Charities Tampa
495Bay, Inc., a not-for-profit organization.
496
497For the purpose of applying the service charge provided in s.
498215.20, contributions received under this subsection are not
499income of a revenue nature.
500     Section 4.  Section 320.0706, Florida Statutes, is amended
501to read:
502     320.0706  Display of license plates on trucks.--The owner
503of any commercial truck of gross vehicle weight of 26,001 pounds
504or more shall display the registration license plate on both the
505front and rear of the truck in conformance with all the
506requirements of s. 316.605 that do not conflict with this
507section. The owner of a dump truck may place the rear license
508plate on the gate no higher than 60 inches to allow for better
509visibility. However, the owner of a truck tractor shall be
510required to display the registration license plate only on the
511front of such vehicle. The owner of any wrecker issued a regular
512wrecker license plate shall display the license plate only on
513the front of the vehicle. The owner of any wrecker issued gross
514vehicle weight wrecker license plates shall display the license
515plates on both the front and rear of the vehicle in conformance
516with the requirements of s. 316.605 that do not conflict with
517this section. A violation of this section is a noncriminal
518traffic infraction, punishable as a moving violation as provided
519in chapter 318.
520     Section 5.  Subsection (6) of section 322.08, Florida
521Statutes, is amended to read:
522     322.08  Application for license.--
523     (6)  The application form for a driver's license or
524duplicate thereof shall include language permitting the
525following:
526     (a)  A voluntary contribution of $1 per applicant, which
527contribution shall be deposited into the Health Care Trust Fund
528for organ and tissue donor education and for maintaining the
529organ and tissue donor registry.
530     (b)  A voluntary contribution of $1 per applicant, which
531contribution shall be distributed to the Florida Council of the
532Blind.
533     (c)  A voluntary contribution of $2 per applicant, which
534shall be distributed to the Hearing Research Institute,
535Incorporated.
536     (d)  A voluntary contribution of $1 per applicant, which
537shall be distributed to the Juvenile Diabetes Foundation
538International.
539     (e)  A voluntary contribution of $1 per applicant, which
540shall be distributed to the Children's Hearing Help Fund.
541     (f)  A voluntary contribution of $1 per applicant, which
542shall be distributed to Family First, a nonprofit organization.
543     (g)  A voluntary contribution of $5 per applicant, which,
544except as provided in s. 320.08058(69)(d), shall be distributed
545to the Autism License Plate Fund administered by Achievement and
546Rehabilitation Centers, Inc., to be used as provided in s.
547320.08058(69).

549A statement providing an explanation of the purpose of the trust
550funds shall also be included. For the purpose of applying the
551service charge provided in s. 215.20, contributions received
552under paragraphs (b), (c), (d), (e), and (f), and (g) and under
553s. 322.18(9)(a) are not income of a revenue nature.
554     Section 6.  Paragraph (zzz) is added to subsection (4) of
555section 320.08056, Florida Statutes, to read:
556     320.08056  Specialty license plates.--
557     (4)  The following license plate annual use fees shall be
558collected for the appropriate specialty license plates:
559     (zzz)  Hispanics Settled Florida in 1565 license plate,
560$25.
561     Section 7.  Subsection (78) is added to section 320.08058,
562Florida Statutes, to read:
563     320.08058  Specialty license plates.--
564     (78)  HISPANICS SETTLED FLORIDA IN 1565 LICENSE PLATES.--
565     (a)  The department shall develop a Hispanics Settled
566Florida in 1565 license plate as provided in this section.
567     (b)  Hispanics Settled Florida in 1565 license plates must
568bear the colors and design approved by the department. The word
569"Florida" must appear at the top of the plate, and the words
570"HISPANICS SETTLED FLORIDA" must appear at the bottom of the
571plate.
572     (c)  The department shall retain all revenues from the sale
573of such plates until all startup costs for developing and
574issuing the plates have been recovered. Thereafter, 50 percent
575of the annual use fees shall be distributed to National Hispanic
576Corporate Achievers, Inc., an organization in Orlando that
577sponsors minority job fairs. The remaining 50 percent shall be
578distributed to Florida Hispanic Foundation. The fees shall be
579used to support job and mentorship programs and to provide
580scholarship grants for needy students from minority communities
581in this state.
582     (d)  By January 1, 2010, the department shall establish a
583method to issue a Hispanics Settled Florida in 1565 license
584plate voucher to allow for the presale of the Hispanics Settled
585Florida in 1565 license plate. Issuance of the vouchers is
586contingent upon payment of an application fee of $10,000 no
587later than December 1, 2009. The processing fee as prescribed in
588s. 320.08056, the service charge and branch charge as prescribed
589in s. 320.04, and the annual use fee as prescribed in s.
590320.08056 shall be charged for the voucher. All other applicable
591fees shall be charged at the time of issuance of the license
592plate. The approved Hispanics Settled Florida in 1565 license
593plate organization must, within 24 months after the
594establishment of the presale voucher, record with the department
595a minimum of 1,000 voucher sales before manufacture of the
596Hispanics Settled Florida in 1565 license plate can commence.
597If, at the conclusion of the 24-month presale period, the
598minimum sales requirements have not been met, the Hispanics
599Settled Florida in 1565 license plate is deauthorized and the
600department shall discontinue development of the plate and
601discontinue issuance of the presale vouchers as prescribed in s.
602320.08056. Upon deauthorization of the license plate, a
603purchaser of the Hispanics Settled Florida in 1565 license plate
604voucher may use the annual use fee collected as a credit towards
605any other specialty license plate or apply for a refund on a
606form prescribed by the department. This paragraph expires
607January 1, 2012.
608     Section 8.  This act shall take effect September 1, 2009.
