A bill to be entitled
2An act relating to purchase of commodities and contractual
3services by local governments; amending s. 287.056, F.S.;
4authorizing special districts, municipalities, and
5counties to purchase specified commodities and contractual
6services from purchasing agreements of other special
7districts, municipalities, or counties; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Section 287.056, Florida Statutes, is amended
13to read:
14     287.056  Purchases from purchasing agreements and state
15term contracts.--
16     (1)  Agencies shall, and eligible users may, purchase
17commodities and contractual services from purchasing agreements
18established and state term contracts procured, pursuant to s.
19287.057, by the department.
20     (2)  Agencies may have the option to purchase commodities
21or contractual services from state term contracts procured,
22pursuant to s. 287.057, by the department which contain a user
23surcharge pursuant to s. 287.1345 as determined by the
24department.
25     (3)  Special districts, municipalities, and counties may
26purchase commodities and contractual services, other than
27services the acquisition of which is governed by s. 287.055,
28from purchasing agreements of other special districts,
29municipalities, or counties that have been procured pursuant to
30competitive bid, requests for proposals, requests for
31qualifications, competitive selection, or competitive
32negotiations and that are otherwise in compliance with general
33law.
34     (4)(3)  Agencies and eligible users may use a request for
35quote to obtain written pricing or services information from a
36state term contract vendor for commodities or contractual
37services available on state term contract from that vendor. The
38purpose of a request for quote is to determine whether a price,
39term, or condition more favorable to the agency or eligible user
40than that provided in the state term contract is available. Use
41of a request for quote does not constitute a decision or
42intended decision that is subject to protest under s. 120.57(3).
43     Section 2.  This act shall take effect July 1, 2009.
