    1                        A bill to be entitled                      
    2         An act relating to assisted reproductive technology;
    3         amending s. 742.14, F.S.; prohibiting any person other
    4         than an attorney from receiving compensation for
    5         making a referral to an egg, sperm, or preembryo donor
    6         or gestational surrogate; prohibiting any person other
    7         than an attorney from advertising for, or seeking, an
    8         egg, sperm, or preembryo donor or gestational
    9         surrogate; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 742.14, Florida Statutes, is amended to
   14  read:
   15         742.14 Relinquishment of rights; compensation; advertising
   16  Donation of eggs, sperm, or preembryos.—
   17         (1) The donor of any egg, sperm, or preembryo, other than
   18  the commissioning couple or a father who has executed a
   19  preplanned adoption agreement under s. 63.212, shall relinquish
   20  all maternal or paternal rights and obligations with respect to
   21  the donation or the resulting children.
   22         (2) Only reasonable compensation directly related to the
   23  donation of eggs, sperm, and preembryos is shall be permitted.
   24  However, except for an attorney, a person may not charge or
   25  accept compensation of any kind for making a referral relating
   26  to an egg donor, sperm donor, preembryo donor, or gestational
   27  surrogate.
   28         (3)Except for an attorney, a person may not advertise or
   29  offer to the public in any manner or by any medium that an egg
   30  donor, sperm donor, preembryo donor, or gestational surrogate is
   31  available or is sought. An attorney publishing or broadcasting
   32  any such advertisement must include his or her Florida Bar
   33  number in the advertisement.
   34         Section 2. This act shall take effect July 1, 2009.
