A bill to be entitled
2An act relating to childhood vaccinations; requiring that
3health care providers disclose information about childhood
4vaccinations to a minor's parent or legal guardian before
5vaccinating the minor; requiring the Department of Health
6to develop a standardized form; prohibiting a health care
7provider from administering a vaccination to a minor until
8after the minor's parent or guardian signs the form;
9requiring that the parent or legal guardian sign the form
10within a certain time; requiring certain health care
11providers to provide information about childhood vaccines
12to patients who are pregnant; requiring the department to
13create and maintain a website; providing an effective
14date.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  (1)  Before vaccinating a minor, a health care
19provider who is licensed in this state and who, as a part of his
20or her scope of practice, administers childhood vaccinations
21shall consult with and disclose to the parent or legal guardian
22of the minor information about any childhood vaccinations that
23may be administered, including, but not limited to:
24     (a)  Information contained in the vaccine package insert
25that details the vaccine ingredients and contraindications.
26     (b)  Potential side effects of the vaccine.
27     (c)  The efficacy of the vaccine.
28     (d)  Risks associated with the disease that the vaccination
29is intended to prevent.
30     (e)  Options that are available with regard to the
31administration of the vaccination, including the timing or
32combination of multiple vaccinations.
33     (2)  The Department of Health shall develop and provide to
34each health care provider who is licensed in this state and who,
35as a part of his or her scope of practice, administers childhood
36vaccinations a standardized form indicating that the health care
37provider has fulfilled the requirements in subsection (1). The
38form shall be kept with the minor's permanent medical record.
39The health care provider may not vaccinate a minor until after
40the minor's parent or legal guardian signs the standardized
41form. The parent or legal guardian of a minor shall sign and
42date the standardized form:
43     (a)  Immediately after the consultation; or
44     (b)  At any time after the consultation when the parent or
45guardian believes that he or she is adequately informed about
46the vaccinations, but before the child is admitted to a licensed
47child care facility in this state or enrolled in prekindergarten
48through grade 12 of a public or private school in this state.
49     (3)  A health care provider who is licensed in this state
50and who, as a part of his or her scope of practice, renders
51prenatal care to pregnant women shall provide information about
52childhood vaccines to each patient who is in her 30th week of
53pregnancy.
54     (4)  The Department of Health shall create and maintain a
55website that contains information regarding each childhood
56vaccination and the standardized form described in subsection
57(2).
58     Section 2.  This act shall take effect July 1, 2009.
