3     Amendment (with title amendment)
4     Remove everything after the enacting clause and insert:
5     Section 1.  Section 406.61, Florida Statutes, is amended to
6read:
7     406.61  Selling, buying, or conveying bodies outside state
8prohibited; exceptions, penalty.--
9     (1)  Any person who sells shall sell or buys buy any body
10or parts of bodies as described in this chapter or any person
11except a recognized Florida medical or dental school who
12transmits shall transmit or conveys convey or causes cause to be
13transmitted or conveyed such body or parts of bodies to any
14place outside this state commits is guilty of a misdemeanor of
15the first degree, punishable as provided in ss. 775.082 and
16775.083. However, nothing in this chapter does not prohibit
17shall be construed as prohibiting the anatomical board from
18transporting human specimens outside the state for educational
19or scientific purposes or prohibit as prohibiting the transport
20of bodies, parts of bodies, or tissue specimens in furtherance
21of lawful examination, investigation, or autopsy conducted
22pursuant to s. 406.11. Any person, institution, or organization
23that conveys bodies or parts of bodies into or out of the state
24for medical education or research purposes shall notify the
25anatomical board of such intent and receive approval from the
26board.
27     (2)  Any entity accredited by the American Association of
28Museums may convey plastinated bodies or parts of bodies into or
29out of the state for exhibition and public educational purposes
30without the consent of the board if the accredited entity:
31     (a)  Notifies the board of the conveyance and the duration
32and location of the exhibition at least 30 days before the
33intended conveyance.
34     (b)  Submits to the board a description of the bodies or
35parts of bodies and the name and address of the company
36providing the bodies or parts of bodies.
37     (c)  Submits to the board documentation that each body was
38donated by the decedent or his or her next of kin for purposes
39of plastination and public exhibition, or, in lieu of such
40documentation, an affidavit stating that each body was donated
41directly by the decedent or his or her next of kin for such
42purposes to the company providing the body and that such company
43has a donation form on file for the body.
44     (d)  For each plastinated body that was first exhibited in
45this state before July 1, 2009, by any entity accredited by the
46American Association of Museums, submits to the board the
47documentation or affidavit required under paragraph (c), or, in
48lieu of such documentation or affidavit, an affidavit stating
49that the body was legally acquired and that the company
50providing the body has acquisition documentation on file for the
51body. This paragraph expires January 1, 2012.
52     Section 2.  This act shall take effect July 1, 2009.

68date.
